“Inja” kusho isilisa noma isifazane salolu hlobo lwesilwane;
“Ipulazi” kusho ingxenye noma izingxenye zomhlaba wezolimo njengoba zichaziwe eMthethweni Wezokuklanywa Komhlaba Wezolimo, 1970, (uMthetho No.70 we-1970), futhi kuhlanganisa nendawo encane, esetshenziselwa ukukhiqiza futhi engumthombo wezemvelo osetshenziswa ngabantu ukukhiqiza phakathi kokunye ukudla, izitshalo kanye neziphuzo eziseqophelweni.

iphindelela, ukuklewula, ukushaya umkhulungwane noma ukubanga eminye imisindo, iphazamisa ukuthula emphakathini noma icasula omakhelwane, yephula le mithetho kamasipala uma isicefe noma ukuphazamisa kuqhubeka ngemuva kokuphela kwesikhathi esifanele esiyobekwa esazisweni esisayinwe yiMenenja kaMasipala kumbe ogunyazwe ukuba ammele, uma ethola isikhalo esibhalwe phansi sasayinwa, sanikezelwa kulowo muntu, simcela ukuba anqamule lokho kuphazamiseka noma isicefe; inqobo nje uma isikhulu esiqokwe ngokusemthethweni ngokoMthetho Wenqubo Yamacala Obugebengu, 1977 (uMthetho No.51 we -1977) kungathi kunoma yiziphi izimo lapho kunesicefe esidinga ukunqandwa ngokushesha, kungasezukulindwa ukunikezelwa kwesaziso njengoba kuhlinzekelwe lapha futhi uma nje sizibonele ngokwaso leso sicefe, sizokhipha isaziso ngokweSigaba 341 soMthetho esikhulume ngawo phambilini sinikezwe umnikazi waleyo nja noma siqhubeke nokuthatha izinyathelo ezinqala njengoba kuhlinzekelwe kule mithetho kamasipala. Uma nanoma ngubani etholakala enecala lokwaphula lo mthetho kamasipala okwesibili maqondana naleso silwane, kuyoyifanela inkantolo, eyomthola enecala, ukuthi ngaphezu kwanoma yisiphi isigwebo eyomnika sona imyalele ukuba asisuse leso silwane ngokuhambisana nomthetho kamasipala 5 (a).
3 NgokoMthetho Kamasipala 2 nangaphandle kokuthunaza kumbe ukunciphisa nganoma iyiphi indlela ilungelo lomnikazi wenja kumbe lowo oyibhekile ngokwaphula le mithethonqubo:
umnikazi wanoma yimaphi amagceke, uma ehlala kulawo magceke, uyothathwa njengogcine leyo nja egcinwe kulawo magceke;
uma umnikazi wamagceke engahlali kuwona, nanoma ngubani oneminyaka engaphezu kwengamashumi amabili nanye ohlala kulawo magceke uyothathwa njengomgcini waleyo nja ekulawo magceke.
Uma emangalelwa ngokwale mithetho kamasipala, kuyobe kuyofaneleka ukuba kubekwe icala umnikazi wangempela waleyo nja kungenjalo, kubekwe icala lowo ogcine inja noma lowo othathwa njengomgcini waleyo nja.
(a) akukho muntu oyovumela nanoma yiyiphi inja okungeyakhe kumbe ebhekwe nguye ukuba itholakele iwuvanzi emgwaqeni kumbe endaweni yomphakathi ngaphandle uma iboshwe ngentambo futhi ibanjwe ngumuntu kumbe iboshwe ngandlela thize emzimbeni, inqobo nje uma kungekho nja eyovunyelwa ukuba itholakale isezingxenyeni zedolobha ezilawulwa nguMkhandlu lapho kunezimpawu ezigqamile ezikhomba ukuthi izinja azivunyelwe, ngaphandle esimweni esihlinzekelwe emithethweni kamasipala 2(e)(2);
(b) Nanoma yiyiphi inja engaboshiwe ngentambo ebanjwe ngumuntu noma engaboshiwe ngandlela thize emzimbeni etholakala impampa kunoma yimuphi umgwaqo womphakathi, indawo yomphakathi noma
isesimweni sokungaphili futhi ingenamnikazi, ingasuswa kumbe ibanjwe ngokuhambisana nomthetho kamasipala 5 (a) noma (b) futhi, uma kutholakala ukuthi iyingozi, inolaka kumbe inesifo ingabulawa yisikhulu esigunyaziwe.
Nanoma yiyiphi inja engesiyo eyomnikazi womhlaba noma wesakhiwo etholakala kuso, uma inomkhuba wokuhlasela nanoma yisiphi isilwane somnikazi walowo mhlaba, kuyobhekwana nayo ngokuhambisana nezihlinzekelo zesigaba 5(a) kuya ku -(g) sale mithetho kamasipala; ngaphandle uma kuyisimo okungelula ukuthi nanoma yisiphi isikhulu esigunyaziwe noma umnikazi akwazi ukuyibamba leyo nja ngezizathu ezithile, isikhulu esigunyaziwe singayalela ukuthi umnikazi waleyo nja kumbe nanoma ngubani ofanelekile oqokwe nguye ukuba ayibulale noma siyibulale sona mathupha. Kunoma yisiphi isimo, izimo mayelana nokubulawa kwaleyo nja ngokwalesi sigaba kuyomele zibikwe emkhandlwini ngokukhulu ukushesha emva kwesehlakalo.
Ngaphandle uma kugunyazwe ngokoMthetho waKwaZulu Wokongiwa Kwemvelo (uMthetho No. 29 we -1992), kumbe nanoma yimuphi omunye umthetho osebenzayo, akukho muntu, ongumnikazi wenja, noma onenja kumbe izinja ezisetshenziselwa ukuzingela, oyovumela leyo nja noma lezo zinja ukuba zizingele kunoma yimuphi umhlaba osendaweni elawulwa ngumkhandlu ngaphandle kokuthola imvume ebhalwe phansi kaNgqongqoshe ofanele kanye nomnikazi walowo mhlaba. Leyo mvume iyovezwa ngumnikazi waleyo nja kumbe lezo zinja kunoma yisiphi isikhulu esigunyaziwe uma siyidinga.
(Ngokwalo mthethonqubo, nanoma iyiphi inja engasifakile isigqebhezane sasentanyeni noma ingenayo into eechaza umniniyo ebonakala njengengenamnikazi iyothathwa njengengenamnikazi).
5 (a) Nonoma yisiphi isikhulu samaphoyisa kumbe elinye iphoyisa eligunyazwe nguMkhandlu ngokusemthethweni esingasusa kumbe sibambe nanoma yiyiphi inja sisebenzisa amandla esiwanikiwe singayithatha noma siyidlulisele endaweni yokuphepha noma kunoma iyiphi inhlangano yezenhlalakahle yezilwane noma indawo egunyazwe umkhandlu lapho kuvalelwa khona izinja.
(b) Nanoma ngubani olanda inja esusiwe noma ebanjiwe ethi ngeyakhe uyovunyelwa ukuba ayithathe emva kokugculisa isikhulu esibhekene naleyo ndawo yokuphepha, inhlangano yenhlalakahle yezilwane kumbe indawo lapho kuvalelwa khona izinja ngokuthi ungumnikazi waleyo nja nangemuva kokukhokha lezi zimali ezilandelayo:
Eyokuhlalisa, ekadokotela wezilwane, eyokudla, neyokuthuthwa kwayo iyiswa endaweni ephephile, eyenhlangano yenhlalakahle yezilwane kumbe indawo lapho izinja zivalelwa khona ngokuhambisana nezilinganiso zemali ebhalwe phansi isikhathi ngesikhathi.
Nanoma yiyiphi inja engalandwanga kwaze kwaphela izinsuku eziyisi- 7 (eziyisikhombisa) ingadayiswa yilowo owengamele leyo ndawo yezokuphepha, inhlangano yezenhlalakahle yezilwane kumbe indawo yokuvalela izinja. Ukuqhutshwa kwalokho kudayisa kuyokwenziwa ukuze kukhokheleke izindleko ezidaleke ngokususwa kanye nokunakekelwa kwenja edayisiwe, bese kuthi imali esele uma ikhona, ikhokhele indawo yokuphepha,inhlangano yenhlalakahle yezilwane noma leyo ndawo lapho kuvalelwa khona izinja.
Uma nanoma iyiphi inja ingalandwanga kwaze kwaphela izinsuku eziyisi- 7( eziyisikhombisa) kumbe ingeke idayiswe ngokwezihlinzeko zalo mtheshwana kamasipala (c) noma uma nanoma yiyiphi inja itholakale ukuthi iyagula noma inesifo esingalapheki noma ilimele kumbe inolaka futhi iyingozi, umuntu owengamele indawo yokuphepha, inhlangano yezenhlalakahle yezilwane kumbe indawo yokuvalela izinja angenza njengokweSigaba 5(1) kanye no (2) soMthetho Wokuvikelwa Kwezilwane, 1962 (uMthetho No. 71 we -1962), njengoba uchitshiyelwa izikhathi ngezikhathi.
Amandla anikezwe nanoma yisiphi isikhulu samaphoyisa angasetshenziswa nayinoma yisiphi isikhulu senhlangano yezenhlalakakhle yezilwane noma indawo yokuvalela izinja egunyazwe ngaphansi kwezihlinzeko zesigaba 8 soMthetho Wokuvikelwa Kwezilwane,(uMthetho No.71 we -1962), njengoba uchitshiyelwa izikhathi ngezikhathi.
Nanoma yisiphi isikhulu singadlulisela nanoma iyiphi inja esiyisusile kumbe esiyibambile kunoma yisiphi isakhiwo kumbe indawo ehlinzekelwe ukugcina izinja ezilahlekile.
Izihlinzeko zomtheshwana kamasipala (e) kanye no- (f) zalo mthetho kamasipala ziyosebenza ekudayisweni kumbe ekubulaweni kwezinja ezisuswe kumbe ezibanjwe yinoma yisiphi isikhulu.
6 Nanoma ngubani olanda nanoma iyiphi inja evalelwe ngaphansi kwemithetho kamasipala engasekuqaleni uyothathwa njengomnikazi, ngaphandle uma enobufakazi obuphikisayo; ngokuba ngumnikazi uyoshushiselwa ukwaphula le mithetho kamasipala.
Akukho muntu ongasebenzisa kumbe avumele nanoma yimaphi amagceke asendaweni ehlala abantu engaphansi kolawulo loMkhandlu ukuba asetshenziselwe ukuhlalisa izinja okungezona ezakhe, kumbe azifuyele ukuzidayisa.
8 Umnikazi noma umuntu obhekele nanoma iyiphi inja efile kumele kube ngumthwalo wakhe ukungcwaba leyo nja ngendlela efanele endaweni evunywe nguMkhandlu, futhi uma umnikazi kumbe umbheki wenja ehluleka noma engakwazi ukuyingcwaba, uMkhandlu uyophoqelela ukuba ingcwatshwe noma ilahlwe ngezindleko zomniniyo kumbe lowo oyibhekele, ngokuhambisana namanani entela anqunyiwe.
9 Akukho muntu, osemgwaqeni kumbe endaweni yomphakathi, oyothusa
ngenhloso, asukele kumbe achukuluze nanoma iyiphi inja.

Isigaba 5 simayelana nezimo lapho isikhulu samaphoyisa singabulala khona nanoma yisiphi isilwane. Sihlinzeka ngegunya lokuthi iphoyisa likwazi ukubulala nanoma yisiphi islwane engekho umniniso kumbe esimweni lapho umniso engavumi, uma isilwane silimele noma sigula ngendlela yokuthi iphoyisa libona kufanele ukuthi sibulawe, uma lizobiza udokotela wezilwane ozoqinisekisa lokho. Esimweni lapho kungekho dokotela wezilwane, iphoyisa lingabiza abantu ababili abadala elibathatha njengabethembekile ukuthi bangathatha isinqumo esiphusile. Uma bevumelana nombono wephoyisa, lingsibulala isilwane.
ISigaba 8 simayelana namandla anikezwe izikhulu zomphakathi ukuvikela ukuhlukunyezwa kwezilwane. Lesi sigaba sinikeza leso sikhulu amandla, uma sigunyazwe ngokubhalwe phansi phambi kweMantshi yesiFunda, ukwenza imisebenzi yephoyisa ngokwesigaba 5.
