Umthetho wezobudlelwane emisebenzini kubaqashi nabasebenzi we-Labour Relations Act, 1995, wamukela ilungelo lokuphiketha. Inyunyane ebhalisiwe  ingagunyaza iphikethi yamalunga ayo kanye nabasekeli ngenhloso yedimonstreshini yokuthula .

Iphikethi ingabanjwa noma kukuphi lapho abantu abanelungelo lokungena, kodwa ngaphandle kwendawo yomqashi, noma ngemvume yomqashi, ngaphakathi kwendawo yomqashi.

Inyunyane ebhalisiwe  noma umqashi bangacela abekhomishana yokubuyisana nolamulo i- Commission for Conciliation, Mediation and Arbitration  ukuzama ukuthola isivumelwano phakathi kwezinhlangothi ezithintekayo kwingxabano ngemitheshwana yolawulo okumele isetshenziswe kunoma yiyiphi iphikethi maqondana nesiteleka noma ukukhiyela ngaphandle. Uma kungenasivumelwano esifinyelelwayo, abe-CCMA kumele benze imitheshwane yolawulo lwamaphiketi, ngokubonelela izimo emsebenzini noma kwezinye izindawo zokuphiketha kanye nenqubo yokuziphatha kahle i-code of good practice.

Imitheshwana yolawulo ivumela abasebenzi ukuthi baphikethe endaweni yomqashi uma i-CCMA ibona ukuthi umqashi wenze okungalungile ngokunqabela iphikethi ngaphakathi kwendawo yakhe.

Uma kunezinhlangothi ezingaphezulu kolulodwa ezithintekayo kwingxabano, noma uma ingxabano ithinta izinhlangothi ezingaphezulu kolulodwa, bhala amanye amagama kanye nemininingwane ephepheni eliseceleni ebese ufakela le mininingwane kwifomu.
