1. ISINGENISO 

1.1 IHLATHULULO 

Kizo zoke iintatimende zoMgomo, imiThetho, imiThetholawulo neZaziso, amagama alandelako la azakutjho lokhu okulandelako, ngaphandle-ke kokuthi kutjhiwo nakatjho okuhlukileko:

"UMTHETHO" Utjho umThetho wezamaNzi (198 ka-1997) njengokutjhugululwa kwawo, namkha omunye umThetho owujamiselelako; 

"UKUZIQOTJHA" Kutjho ukulova emsebenzini nankha ukulova emsebenzini amalanga alandelane ngaphandle kwesizathu esizwakalako namkha imvumo esemthethweni;

"UMRHOLO ONZINZILEKO" Utjho umrholo wamambala onzophileko nonzinzileko orholelwa wona ngaphandle kwezinye iimbonelelo zangeqadi, namabhonasi nobunye ubuhle bangeqadi obuthola ngokusebenza kwakho umsebenzi owusebenzako;

"IPAHLA" Itjho yoke ipahla ejamileko negugekako yeBhodi yezamaNzi yeKangala, sekubalwa nalo loke ilwazi nanyana litlolwe ngesandla nanyana ligadangiswe ngomtjhini, nanyana lisediskini yekhomphiyutha, nanyana lisekhomphiyutheni ngokwayo nanyana lisefilimini; 

"ISIKHWAMA SOKUBEKELA" Sitjho isiKhwama sokuBekela seBhodi yezamaNzi yeKangala njengoba sirejistarwe eBhodi yezeeMali nemNyangweni wezeNgeniso;

"IMBADALO" Itjho umrholo onzinzileko, iimali zeembonelelo, amabhonasi kunye nobunye ubuhle bangeqadi obutholakala emsebenzini umsebenzi abuthola bunqopha namkha ngenye indlela njengendlela yokubhadalelwa umsebenzi awenzako;

"ILANGA LOKUTHATHA UMHLALAPHASI" Litjho ukuphela kwenyanga umsebenzi ahlanganisa ngayo iminyaka yokuthatha umhlalaphasi,, abe alungele ukuthola iimfanelo ezitholwa ngabathethe umhlalaphasi ngokwemiThetho yomhlalaphasi yeBhodi yezamaNzi yeKangala; 

"ISIKHATHI SOMSEBENZI" Sitjho isikhathi esithileko selanga umuntu ekufuze abe semsebenzini ngaso, ngokwahlukahluka kwamakoro ngamakoro womsebenzi. 
 

1. ISINGENISO 

1.2	IKAMBISOLAWULO EVAMILEKO 

1.2.1	IBhodi yezamaNzi yeKangala izibophelele ngomthetho wekambisolawulo wokungabandlululi abantu ngokungakafaneli ngombala, ngobulili, ngekolelombono, ngobuqhwala namkha ngokhunye; ngalokho-ke inqophe ukusebenzisa lekambisolawulo ekusebenzeni kwayo ngemithombo yamandla wabantu:

*	Ubudlelwana obuhle ekutlameni nekusetjenzisweni komgomo.
*	Ukwakhiwa nokunzinziswa kweendlela zokuthintana ezihle nezinepumelelo.
*	Imirholo emihle, namathuba amahle wokuthwasela umsebenzi nawokukhutjhulwa emsebenzini, njalo njalo.
*	Ubudlelwana obuhle nabajameli babasebenzi.
*	Ukwakha nokubambelela ekambisweni ehle nelungileko yezokukhalima neyokutjheja iinlilo ngokuhlonipha imithetho yezabasebenzi neemvumelwana ezihlanganyelweko.
*	Ukuba nabasebenzi abaneleko abanelwazi nelimuko elifunekako nabazimiseleko ukusebenza ngesibopho sokuziphendulela ekuphumeleliseni iminqopho yeBhodi.
*	Ukurarulula imiraro ngokukhulumisana, nangokuhlanganyela ekubonisaneni nangokuvumelana la koke la kukghonakala khona ngaphandle kokukhisimeza isithunzi seBhodi.
*	Ukwakha umoya omuhle wokuthembana nokuvulelana iimfuba kibo boke abasebenzi nabaphathi.
*	Ukwakha isiko nomoya wokusebenza ngokuncama, nangokuzihlonipha, nangokuzikhuthaza kunye nangokubambisana kibo boke abasebenzi.
*	Ukuvulela boke abasebenzi amathuba wokuthwasiselwa umsebenzi nokuthuthukiswa amakghono wabo ngokupheleleko ngaleyindlela-ke babe lisizo khudlwana eBhodini nemphakathini abawusebenzelako. 

1.2.2	UmThetho wezabaSebenzi ka-1995 (i-Labour Relations Act of 1995) ngeKomidi yemiSebenzi ekuPhilwa ngayo (i-Essential Services Committee), ikhombe ukuphakelwa kwamanzi ebantwini njengomsebenzi oqakathekileko ekuphilwa ngawo. IBhodi yezamaNzi yeKangala izakulinga ngawo woke amandla ukwenza iimvumelwana ezihlanganyelweko zokwenzela abantu/umphakathi ubuncani bemisebenzi eqakathekileko ekhonjwe njengemisebenzi ekuphilwa ngayo. 



1.3	AMATHUBA WOMSEBENZI

1.3.1	Amathuba womsebenzi kinanyana ngisiphi isikhundla somsebenzi esivulekileko eBhodini yezamaNzi yeKangala anikelwa boke abantu abayizalisako imibandela efuneka esikhundlensi somsebenzeso. Nokho-ke nanyana kunjalo, ithuba lokuthoma lizakuvama ukunikelwa abasebenzi beBhodi ntanzi neZakhamu zeSewula Afrika ezazidimeke amathuba phambilini.
1.3.2 Ihlelo lokufuna nokukhetha abasebenzi lizakwenzelwa emkhanyweni nangendlela elungileko, kodwa-ke nokho ilwazi lomuntu siqu sakhe, njengesibawo somsebenzi, incwadi ehlathulula ubuyena neemfundo zakhe nelwazi lakhe (i-CV), nemibiko yecociswano lomsebenzi mathupha, nemitlolo yokulingwa komuntu kunye nemiphumela yokuhlolwa kwamandla wengqondo yakhe zizinto ezithathwa njengezinto ezisifuba. Lezi zizinto ezizakuvezwa kwaphela ngaphakathi kweBhodi, kilabo nakanjani ekufaneleko ukuthi bazi ngazo, ngokulandela imithetho elawula lokho. 
1.3.3	Iinsetjenziswa ezisetjenziselwa ukuhlola nokulinganisa amandla wekghono lomuntu ekukhethweni komuntu olungele umsebenzi zizakuba ngezithembekileko nezilungileko, ezingakatjhigameli ncanye ngokwesiko namkha ngenye indlela. 

1. 4 IHLELO LOKULUNGISELA ABABEDIMEKE AMATHUBA 

1.4.1 IBhodi yezamaNzi yeKangala izibophelele ngomthetho wekambisolawulo wehlelo lokulungisela ababedimeke amathuba elakhako nelinomnqopho.
1.4.2	Izakuhlonitjhwa ibe iqalelelwe itlhogeko yokufuneka kwabantu ababedimeke amathuba phambilini, abantu besifazi, nabaqhwalileko (malungana nokutholakala kwamathuba womsebenzi). 
1.4.3	Ukuphakamisa nokukhuthaza ikambisolawulo yokuqalelela abantu ababedimeke amathuba phambilini, kuzakutjhejwa bona ntanzi abantu ababedimeke amathuba, kwaphela nakube umsebenzi ofunelwa umuntu loyo banefundo yawo efaneleko, noba/namkha banelwazi lawo ngokwaneleko, noba/namkha banekghono lawo, noba/namkha banelimuko lawo. Lokhu-ke nokho akutjho ukuthi abanye abantu abakavunyelwa ukuqatjhwa, kodwa kutjho ukuthi abantu ababedimeke amathuba phambilini kuzakutjhejwa bona ntanzi nakunesikhundla somsebenzi esivulekileko. 
1.4.4	Nakufumaniseka ukuthi akatholakali umuntu ongavala iiskhundla somsebenzi hlangana nabantu ababedimeke amathuba (ngaphakathi nangaphandle kweBhodi), kodwa sekunomunye osele avele asebenza eBhodini yezamaNzi yeKangala osele abonakele anamandla wekghono lokuvala isikhundleso ngemva kokuthwasiswa, kungakhethwa omunye umuntu wangaphandle ongaje abambe isikhundleso kwesikhatjhana namkha ngekontraga, bekube mhlazana loyo okhonjelwe ukuthwasiselwa umsebenzi loyo aqeda ukuthwasiswa, bese kungena yena-ke kileso isikhundla. 
1.4.5	IBhodi yezamaNzi yeKangala izakuthatha amagadango wokuqinisekisa ukuthi abantu esele vele basebenza kiyo banikelwa amathuba wokufunda nokuthwasela umsebenzi, bakhuphule iimfundo zabo zelwazi lomsebenzi ezizabenza bakhule bakghone ukuthola iinkhundla ezingcono khona eBhodini ngokwelwazi nekghono lamandla wabo lomsebenzi, kuye-ke ngokuthi zikhona na iinkhundla ezifaneleko abangafakwa kizo ngesikhatheso. 
1.4.6	IBhodi yezamaNzi yeKangala izakuvulela abantu bayo amathuba wokukhula ngebizelo labo la kukghonakala khona, kobanyana abantu ababedimeke amathuba phambilini bazokwazi ukuthola amathuba wokuthola ilimuko, ngaleyindlela-ke bakghone ukuphakanyiselwa eenkhundleni zomsebenzi eziphezulu. 

1.5	IMIBANDELA YOKULINGANISWA NOKULUNGISA 

1.5.1 Ukutjhiyana kwemirholo, isikali somrholo nayo yoke eminye imibandela esebenza ngembadalo kubekwa ngendlela engabandlululiko. Kumugomo weBhodi yezamaNzi yeKangala ukurholela nanyana ngubani emsebenzini othileko umrholo olingana newezinye iindawo emsebenzini ofanako, ngokunjalo athole nabo boke obunye ubuhle obukhambisana nomsebenzi loyo ngokufanako nangokulinganako nakezinye iindawo emsebenzini ofanako la kusebenza khona iBhodi yezamaNzi yeKangala kunye neenkhundleni ezifanako ngaphakathi kwayo. 
1.5.2	Iinkhundla zomsebenzi ziphiwa amagreyidi ngendlela esetjenziswa nevumeleke ilizwe loke, ngokuqala ukuthi umuntu osesikhundleneso wenzani nokuthi unamandla wokuthatha iinqunto ukufikaphi. Ihlelo lokugreyida iinkhundla zomsebenzi elibizwa ngokuthi yi-HAY Grading System lona hlelo elisetjenziswa yiBhodi yezamaNzi yeKangala njengehlelo langokomthetho lokulinganiswa kweenkhundla zomsebenzi. 
1.5.3	Zoke iindawo neensetjenziswa , njengeendawo zokuzigedla, izindlu zokuphumulela kunye nezindlu zokuhlala zitholakala kibo boke abasebenzi. Nakube kukhona la kufuze kusetjenziswe khona imibandela ethileko ngenca yobukhulu bendawo ngokwayo, njengobukhulu beromu, imibandela leyo izakusetjenziswa ngokwamagreyidi nangokwamandla wemali kwaphela.
1.5.4	Boke abasebenzi bavumelekile ukuthi bangajoyina nanyana isikimu namkha isikhwama seemali iBhodi yezamaNzi yeKangala esenzele abasebenzi bayo, njengesiKhwama seeMali sokuBekela nje, nesiKhwama seeMali zokweLatjhwa, nehlelo lokusizwa ukuthola indlu, njalo njalo, ngokulawulwa mithetho yesikhwameso namkha isikimeso ngemithetho yeBhodi. 


1.6 AMATJHUGULUKO

1.6.1	ImiThetho le inganande itjhugululwa namkha ingezelelwe ngokukhulumisana, ngokubonisana nangezaziso ezitlolwe emabhodini wezaziso weBhodi yezamaNzi yeKangala. Abasebenzi abazasolo basebenza eBhodini le emveni kobana sekwenziwe amatjhuguluko namkha kufakwe iingeelelo ezinjalo kuzakuthathwa ukuthi bayavumelana namatjhuguluko anjalo wemioThetho. 


1.6.2	ImiBandela yomSebenzi le, nemiThetho nemiThetjhwana izakuthatha ukuthi ingezelelwa phezu kwemithetho engakatlolwa yeBhodi yezamaNzi yeKangala noba/namkha yabasebenzi bayo, ngalokho-ke kufuze bona ifundwe ndawonye nemibandela esebenza phezu kwabasebenzi beBhodi yezamaNzi yeKangala njengoba itholakala emiThethweni ehlukahlukeneko. 

2. IMBADALO 

2.1 ISINGENISO 

2.1.1	Lapha kusetjenziswa umthetho wekambisolawulo ngaphandle kokuphambuka.
2.1.2	Kulandelwa ikambiso yokuthi "umuntu akabhadalelwa isikhathi angakasisebenzi".

2.2	IHLELO LOMRHOLO NELOKULINGANISWA KOBUHLE BOMSEBENZI WOMUNTU

2.2.1	Izinga lomrholo lizakubekwa ngo: 

 (a).	kulandela ikombandlela/umlayelo weBhodi;
 (b).	kulandela ikombandlela/umlayelo weDWAF;
 (c).	kukhulumisana neenhlangano ezijamele abasebenzi ngeenkundla zokukhulumisana njengokweemvumelwana zokusebenzisana;
 (d).	kulandela imikhambo nendlela yeemakethe;
 (e).	kuqala ukuthi umsebenzi ngamunye usebenza njani. 

2.2.2	Ubuncani bomrholo womuntu uzakubekwa liphiko lezabasebenzi iBhodi yezamaNzi yeKangala ekilo, kanti nemikhawulo yalokho izakubekwa ngiyo iBhodi. 
2.2.3 Boke abasebenzi bazakurhola ngenya. Umrholo womuntu uzakufakwa ebhanga yomunye nomunye umsebenzi. 
2.2.4	Imbadala namkha umrholo womuntu uzakuba sifuba hlangana komsebenzi neBhodi yezamaNzi yeKangala, ngalokho-ke umrholo womuntu asoze watjelwa omunye umuntu ngaphandle kwabantu abawufunela ukwenza umsebenzabo.
2.2.5	Ukukhutjhulwa komrholo ngomnyaka ebaphathini beenkhundla eziphakemeko (i-HAY points ye-392+) kuzakubekwa yiBhodi, ngokuqala ukuthi umphathi ngamunye usebenza njani njengokwesivumelwana seKontraga yokuSebenza esenziwa umphathi ngamunye nakaqatjhwako. Imininingwana yekontraga, enganande itjhugululwa ngokubonisana nomsebenzi ngnamunye, ihlathululwa esiHlomelelweni somGomo lo.
2.2.6	Ukukhutjhulwa komrholo ngomnyaka kabanye abasebenzi kuzakubekwa yiBhodi ngokulandela ikambiso eku-2.2.1 ngehla. Lapha-ke kuzakusebenza ihlelo lokulinganisa umsebenzi womuntu (i-Performance Evaluation System) elifaneleko.

2.3 ISIKHWAMA SOKUBEKELA 

2.3.1	Kukatelelekile ukuthi boke abasebenzi beBhodi yezamaNzi yeKangala abangaphasi kweminyaka ema-60 babe malungu wesiKhwama sokuBekela seBhodi le, begodu ubulungu besikhwamensi buzakukhamba ngemiThetho yasoisKhwamesi. 
2.3.2	Umsebenzi oqatjhwa selangaphezulu kweminyaka ema-60 angeze aba lilungu lalesisiKhwama sokuBekela seBhodi yezamaNzi yeKangala. 
2.3.3	Boke abasebenzi beBhodi yezamaNzi yeKangala iminyakabo yokuthatha umhlalaphasi ma-60 weminyaka. 
2.3.4	Akunamali umsebenzi adoselwa yona emrholweni kobana iyokuphoselwa esiKhwameni sokuBekela, kodwa iBhodi iphosela ama-20 wamaphesente womrholo opentjhinelwako womsebenzi.
2.3.5	Umsebenzi nakalisa umsebenzi unikelwa ingcenye yakhe yemali ephuma esikhwamenesi, anikelwe godu nengcenye ebeyiphoselwa yiBhodi kunye nemalinzalo emfaneleko, ngokwemiThetho yaso isKhwamesi.

2.8.7	I-overtime esetjenzwe babantu abasebenza amatjhifu ibhadala kanye nohafu (X1.5) kunomrholo ojayelekileko. I-overtime umuntu ayisebenze ngelanga ebekufuze aphumule ngalo, nangoSonto kunye nangeholideyi ukube vele umuntu loyo bekufuze asebenze mhlanokho, ibhadalwa ngokubuyelelwe kabili (X2) kunemali yomrholo ejayelekileko. 

2.9	IMALI YESIBONELELO SAMAHLALO, SOKUDLA NESAMAKHAMBO
 
2.9.1	Ibhodi yezamaNzi yeKangala iyamupha amalalo umsebenzi ekufuze bona ayokulalala ngaphandle akhambe ngomsebenzi.

2.9.11	Abasebenzi abaya eendaweni ngokuyokufunda njengengcenye yehlelo labo lokuthuthukiswa emsebenzini njengoba kuhlele iBhodi yezamaNzi yeKangala bazakulawulwa ngomgomo wehlelo elinjalo nangemibandela ekhambisana nomgomo wehlelo lokuthuthukiswa emsebenzini. 

2.10	IMALI YESIBONELELO SE-STANDBY NESAMATJHIFU 

2.10.1	 Woke umsebenzi otlolelwe incwadi watjelwa ukuthi abe ku-standby uyabhadalelwa ukuba kwakhe ku-standby.

2.10.6	Nokho-ke itjhifu yemini yona ayinamali engezelelweko ebhadalelwa yona. 

2.11	IREJISTA YOKUZIBIKA EMSEBENZINI 

2.11.1	Kuzakuba nerejista yokuzibika emsebenzini ezakutlikitlwa ngibo boke abasebenzi.

2.12	IMALI YESIBONELELO SOKUBAMBELA UMSEBENZI

2.12.1	Umsebenzi obamba isikhundla esiphakemeko kunesakhe isikhathi esidlula amatjhumi amathathu wamalanga (30) ngasikhathi sinye, kufuze athole imali eesibonelelo sokubambela umsebenzi.
2.12.2	Nanyana kukunini umuntu nakufuze ayokubambela emsebenzini, kufuze bona thome ngokuzalisa iforomu lokubambela isikhundla esiphezulu kunesakhe, lidluliswe sikhulu esifaneleko, ngaphambi kobana umuntu loyo angathoma abambe isikhundla ekufuze abambele kiso omunye.

3.	1LIFU

3.1	IKAMBISOLAWULO EVAMILEKO

3.2	ILIFU YOKUPHUMULA

3.2.4	Ilifu yabasebenzi abasebenza unomphela eBhodini le izakubalwa ngalindlela:

* 	Amaphezu we-HAY ayi-392 nangaphezulu: enza amalanga wekhalenda amatjhumi amathathunahlanu (35) ngeenyanga ezilitjhumi-nambili (12);
*	Amaphuzu we-HAY angaphasi kwe-392 enza amalanga wekhalenda amatjhumi amabili-nahlanu ngeenyanga ezilitjhumi-nambili (12).

3.2.5	Ilifu ephunywa ngomnyaka umuntu kufuze enze isibawo sayo kusasele amalanga alitjhumi-nane (14) ubuncani bakhona, ngaphambi kobana ayithome. Ilifu enjalo izakuqalwa mPhathi womNyango loyo la kusebenza khona umsebenzi loyo ukuthi ilungile na ngesikhatheso, ngokuqala iintlhogeko zeBhodi zangesikhatheso. 3.2.6	Umuntu angalelwa ukuthatha ilifu ngenca yobujamo bomsebenzi. Nakube kuyenzeka umuntu alelwe ukuthatha ilifu, iphuzu eliku-3.2.7 ngenzasapha kusafuzile nokho ukuthi liqalelelwe.
3.2.7	Boke abasebenzi kufuze umsebenzi ngamunye athathe ilifu yamalanga alitjhuminambili (12) ubuncani bakhona ngokulandelana nngomnyaka, kanti godu ilifu enjalo kufuze bona ithathwe kungakapheli iinyanga ezilitjhuminahlanu (15) ukusukela ekupheleni kwelifu yokugcina umuntu agcine ukuyithatha. 
3.2.8	Kunamalanga welifu alitjhuminambili (12) umuntu ekufuze bona awathathe ngokulandelana; amanye-ke amalanga welifu asala lapho angabutheleleka abe ayokufika ekhulwini elinamatjhumi amabili (120) ebasebenzini abaneminyaka engaphasi kemihlanu (5), kanti-ke kilabo abaneminyaka engaphezulu kemihlanu basebenza eBhodini le, amalangabo welifu angabutheleleka abe ahlanganise ikhulu elinamatjhumi abunane (180). 
3.2.9	Amalanga welifu abutheleleke abe ahlanganisa I-120/180 kufuze bona athathwe ngaphambi kobana umuntu aphume emsebenzini nakube uyaphuma, nakungasinjalo, ayadliwa amalanga lawo. 
3.2.10	Nakube kuyenzeka umuntu abhubhe, iBhodi yezamaNzii yeKangala izakubhadala indlalifa ekhethwe msebenzi obhubhileko loyo imali elingene amalanga welifu umsebenzi loyo akweledwa wona ukufikela ngelanga lokugcina asese msebenzi weBhodi, ngokwemibandela eku-3.2.8 naku-3.2.9. 
3.2.11	Abasebenzi abatorhako nabo ilifu bayayithola, ngokulandela imibandela yomThetho oLawula imiBandela yokuSebenza kwabaSebenzi -- I-Basic Conditions of Employment Act (Act 75 of 1997). 
3.2.12	Abasebenzi abasebenza amatjhifu abasebenza ngamaholideyi bazakubhadalelwaa ukusebenza ngeholideyi, njengokweKambiso yezomRholo. 
3.2.13	Nakube iholideyi ingoSonto, umVulo wangakusasa kwakhona uba yiholideyi.

3.3	ILIFU YOKUSEBENZA IMINYAKA EMINENGI 
 

3.3.1 Ilifu yokusebenza iminyaka eminengi, elingana namalanga welifu yokuphumula ibutheleleka komunye nomunye umsebenzi osebenza unomphela nakuphela iminyaka emihlanu (5) umuntu asebenza ngaphandle kokuqintelisa eBhodi yezamaNzi yeKangala, ngokwemibandela eku-3.3.4. 
3.3.2  Lelifu ekukhulunywa ngayo ku-3.3.1 ngehla yenzeka kwaphela emuntwini osebenza unomphela eBhodini nakaqeda iminyaka emhlanu ngokulnadelana asebenza khona. 
3.3.3 Ubuncani bakhona umuntu kufuze athathe ihafu (50%) yelifu yokusebenza iminyaka eminengi namkha ayithengise ibe yimali kungakapheli iinyanga ezilitjhuminambili (12) ilifu leyo ihlangene. Amalanga walelifu asala lapho, angabutheleleka ngokwemibandela eku-3.2.8, futhi angathathwa njengelifu namkha athengiswe abe yimali nanyana kukunini.
3.3.4 Nakube kuyenzeka umsebenzi aphume emsebenzini ngemva kweminyaka emihlanu (5) ngokuthokoza umsebenzi, ngokuthatha umhlalaphasi, ngokuphelelwa msebenzi, ngokugula namkha ngokufa, ilifu yokusebenza iminyaka eminengi izakubhadalwa umuntu loyo ngokulinganisa isikhathi asisebenzileko ngokubala iinyanga ezilitjhuminambili (12) asebenza lapho namkha ingcenye yakhona nanyana ingaba ngangani. 

3.4  ILIFU YAMAGULO 

3.4.1 Ilifu yamagulo ibalwa ngeminyaka emithathu ukusukela ngelanga umuntu angene ngnalo emsebenzini eBhodini le. 
3.4.2 Ilifu yamagulo komunye nomunye umsebenzi osebenza unomphela imatjhumi alithoba (90) wamalanga wekhalenda umzombe ngamunye welifu ngesilinganiso esipheleleko sokubhadalwa, namanye amatjhumi alithoba (90) wamalanga ngamatjhumi amahlanu wamaphesente (50%) womrholo wakhe onzinzileko. 
3.4.3  IBhodi yezamaNzi yeKangala umsebenzi ingamngezelelela ilifu yamagulo ngokubona kwayo nakube umuntu loyo sewuwasebenzise woke alamanga wakhe welifu, nakube iBhodi ibona kufuneka yenze njalo.
3.4.4 Ilifu yamagulo edlula emalangeni amabili womsebenzi ngokulandelana umuntu angayithola kwaphela nakube uveza incwadi yamagulo ebuya kwadorhodera namkha emelaphini obhaliswe njengomelaphi; incwadi leyo kufuze bona itjho isifo ebesiphethe umsebenzi namkha itjho ukulimala kwakhe nakube bekalimele; leyo ilifu enjalo izakunikelwa ilingane nesikhathi esitjhiwo ngudorhodera namkha umelaphi loyo, njengoba kuzabe kusitjho incwadi kadorhodera namkha umelaphi loyo. 
3.4.5 Nokho-ke umsebenzi kungafuneka ukuthi aveze incwadi kadorhodera ekhuluma ngokugula kwakhe ngitjho nanyana agule isikhathi esingaphasi kwamalanga amabili, nakube isiKhulu esiPhetheko seBhodi yezamaNzi yeKangala namkha esinye isiphathiswa seBhodi le sibona kufuneka ukuthi kwenziwe njalo. 
3.4.6 Umsebenzi angeze anikelwa ilifu yamagulo yokuhlala ekhaya nakube isiKhulu esiPhetheko namkha esinye isiPhathiswa esijamele isiKhulu esiPhetheko sibona ukuthi ukugulokho namkha ukulimala komsebenzi kube ngenca yobudlabha bakhe namnkha yokungaziphathi kwakhe kuhle abhalelwe kukuziphephisa ekugulenokho namkha ekulimalenokho. Nakufumaniseka ukuthi umsebenzi ubhalelwa kukuza emsebenzini ngendlela enjalo, uzakudoselwa imali elingana nesikhathi asihlezi angekho emsebenzini, emveni kobana sele anikelwe ithuba lokuzikhulumela ngokungabi khona kwakhe emsebenzini ngesikhatheso. 
3.4.7 IBhodi yezamaNzi yeKangala inelungelo lokuthumela umsebenzi kudorhodera ozakukhonjwa yiBhodi kobana ayokuhlola umsebenzi loyo, ngeendleko zayo iBhodi. 
3.4.8 Nakube unikelwe ilifu yamagulo ngenca yokulima namkha yokugula ukube umsebenzi loyo angakghona ukubiza imali yokumlililisa ngenca yokulimalokho namkha yokugulokho ndawana, iBhodi inelungelo lokubuyisa imali eyilahlekeleko ngenca yokungabi khona komsebenzi loyo emsebenzini kuye umsebenzi loyo, nakube imali iBhodi engayibuyisa ngendlela enjalo ayidluli umrholo womsebenzi loyo namkha obunye ubuhle umsebenzi loyo abekangabuthola emsebenzini ngesikhathi azabe angekho ngaso emsebenzini, futhi nakube imali leyo ayidluli iindleko zokugula namkha zokulimala kwakhe umsebenzi. 
3.4.9 Umsebenzi ogula namkha alimale aselifini yokuphumula, ekhethekileko namkha yokuyokubhebhula uzakunikelwa ilifu yamagulo elingana isikhathi sakhe agule ngaso, ekuvezwe nobufakazi bokuthi nangambala ugule/ulimele isikhathi esingako. 
3.4.10 Boke abasebenzi kufuneka babikele abaphathi babo kungakapheli ama-awa amatjhumi amabili-nane (24) nakube babhalelwa kukuya emsebenzini ngenca yokugula namkha yokulimala, babe baveze nokuthi kulindeleke ukuthi bangakghona nini ukubuyela emsebenzini. Ebasebenzini abasebenza amatjhifu, umphathi wabasebenzabo kufuze ukuthi abikelwe ubuncani bakhona kusasele i-awa ngaphambi kobana ithome itjhifu umuntu ebekufuze ayisebenze. 
3.4.11  Abasebenzi abasebenza unomphela abanesikhathi esingaphasi kweenyanga ezilitjhuminambili (12) basebenza bazakunikelwa ilifu ebalwa ngamalanga amabili (2) wenye nenye inyanga abayisebenzileko, ngomrholo opheleleko, namalanga amabili (2) angezelelweko, ngehafu (50%) yomrholo wabo. 
3.4.12  Abasebenzi abatorhako nabo bayayithola ilifu yamagulo, ngokwemibandela yomThetho olawula Iindlela zokuSebenza kwabaSebenzi ? i-Basic Conditions Employment Act. 

3.5  ILIFU YOKUYOKUBHEBHULA 

3.5.1  Umsebenzi osebenza la eBhodini uthola iinyanga ezine (4) ngnokulandelana zokuyokubhebhula. 
3.5.2   Umsebenzi oselifini yokuyokubhebhula uthola amatjhumi amathathu wamaphesente (30%) womrholo wakhe nakaseselifini yokubhebhula, athole nazo zoke ezinye iimfanelo avamise ukuzithola nakasemsebenzini. 
3.5.3   Umsebenzi angathoma ilifu yokuyokubhebhula:

3.5.3.1  nanyana kukunini ukusukela eemvekeni ezine (4) ngaphambi kwesikhathi sokubhebhula, ngaphandle-ke kokuthi kuvunyelwanwe ngenye indlela. 
3.5.3.2  ngelanga udorhodera namkha umbhebhulisi abona kufanele ngalo ukuthoma ilifu yokubhebhula, ngokuqala ipilo yomsebenzi loyo namkha yomntwana olungiselelwa ukubhejulwa loyo. 

3.5.4  Akunamsebenzi ozakuvunyelwa ukubuyela emsebenzini kungakapheli iimveke ezintathu abhebhulile, ngaphandle-ke kokuthi udorhodera namkha umbhebhulisi abona umsebenzi loyo akulungele ukubuyela emsebenzini ngaphambi kwesikhathi esingako. 
3.5.5  Umsebenzi obuya endleleni selasesiquntwini sesithathu asebantwini, namkha obeletha umntwana othulileko kufuze athole ilifu yokubhebhula yyemveke ezintandathu (6) ngemva kobana avelelwe ngilokho, nanyana ilifu yakhe yokuyokubhebhula besele ithomile nanyana beyingakathomi nakavelelwa ngilokho. 
3.5.6  Umsebenzi kufuze bona atlole incwadi abikela ngayo umqatjhi wakhe - ngaphandle kokuthi-ke mhlamunye akakghoni ukwenza njalo - ngelanga azimisele : 

3.5.6.1  ukuthoma ngalo ilifu yakhe yokubhebhula
3.5.6.2   nazimisele ukubuya ngalo emsebenzini ngemva kokubhebhula

3.5.7  Inothisi malungana no-3.5.6 kufuze ithunyelwe: 

3.5.7.1  kusasele iimveke ezine (4) ubuncani bakhona, ngaphambi kobana umsebenzi athome ilifu yokuyokubhebula, namkha 
3.5.7.2   nakube akukghonakali ukwenza njalo, ithunyelwe msinyana ngesikhathi ekungakghonakala ngaso. 

3.6  ILIFU YOKUFUNDA 

3.6.1  Umsebenzi oyokutlola iinhlahlubo, nanyana oyokuhlahlubwa ngokubuzwa ngomlomo unikelwa ilanga linye (1) lelifu yokufunda, elililanga lomsebenzi eliza ngaphambi kwelanga leenhlahlubo; lapha-ke kubalwa neenhlahlubo zonzaliselela. 
3.6.2   Umsebenzi unikelwa godu ilanga linye (1) lelifu yokufunda lokutlola iinhlahlubo, nanyana ayokuhlahlubwa ngokubuzwa ngomlomo, ngelangelo lokutlolwa kweenhlahlubo. 
3.6.3   Isibawo sokuphiwa ilifu yokufunda kufuze siphekelelwe bufakazi beenhlahlubo eziyokutlolwa. 
3.6.4  Iimfundo umuntu azifeyilileko, azibuyelelako, angeze umuntu aphiwa ilifu yokufunda yokuyozitlola. 
3.6.5   Abasebenzi abenza iimfundo ze-Magister namkha ze-Doctorate bazakunikelwa amalanga welifu yokufunda alitjhuminahlanu (15) nabasafundela iimfundo ezinjalo. 
3.6.6   Umsebenzi uzakunikelwa itjhumi lamalanga (10) welifu yokufunda ngomnyaka nakenza iimfundo ezikhambisana nomsebenzakhe kwaphela nakasafundela ukuthola iincwadi ezithileko, (njengeziqu ze-Honours, iDiploma njalo njalo). Ilifu enje-ke isebenza kwaphela ebafundini abafunda emaYunivesithi, nemaTechnikon, nemaKholeji namkha kuma-National Education Institutrions. 
3.6.7   Ilifu yokufunda abasebenzi bazakunikelwa yona kwaphela nabenza iimfundo ezivunyelwe siKhulu esiPhetheko namkha esinye isiPhathiswa esijamele isiKhulu esiPhetheko, kwabonakala ukuthi ziimfundo eziphathelene nezikhambisana nomsebenzi owenziwa eBhodini yezamaNzi yeKangala, ngokomgomo wezeFundo osebenza kileBhodi. 

3.7  ILIFU EKHETHEKILEKO/YOKUQALA ZOMKHAYA

3.7.1  Umsebenzi angabawa ilifu ekhethekileko, nakube: 

* uya ekhotho ngoba ikhotho ukuthi ayokuba ngufakazi ecaleni;
*  uya ekhotho njengommangalelwa ngesikhundla sakhe somsebenzi;
* uyokujamela iRiphabhligi yeSewula Afrika namkha iPhrovinsi nanyana kungaba ngiyiphi yalapha ekhethu kezemidlalo ngoba anelitho alenzako emidlalweni leyo, njengokuthi abe mphathi wemidlalo, ijaji e,idlalweni namkha abe ngusofengwana; isikhathi selifu enjalo umuntu angasithola akukafaneli ukuthi sidlule emalangeni alikhomba (7) wekhalenda ngomnyaka;
*  uyokwethweswa iziqu namkha idiploma endaweni yefundo ephakemeko; isikhathi selifu yokwenza lokhu lilanga linye (1) , ngomnyanya / ngomcimbi munye; 
*  uyokuthutha uyokuhlala kenye indawo ngoba iBhodi yezamaNzi yeKangala imtransferile; ilifu yokwenza lokhu-ke ayidluli emalangeni amabili. 

3.7.2  Isibawo selifu yokwenza koke lokhu okungehla kufuze ukuthi sihlale siphekelelwa bufakazi obutloliweko ngaso soke iiskhathi. 
3.7.3   Abasebenzi abasebenza unomphela eBhodini le banamalanga amathathu weLifu yokuQala zomKhaya ngomnyaka; ilifu enjalo-ke umsebenzi uyithola ngokuyibawa nakube ugulelwa mntwana, namkha nakube ubhujelwe mkakhe namkha umlingani wakhe wasafuthi, namkha umzali wegazi namkha wokutholwa, namkha ugogo namkha namkha umkhulu, umntwana wegazi namkha umntwana wokutholwa, isizukulwani namkha udadwabo namkha umfowabo. Umqatjhi kungenzeka afune ubufakazi obubonakalako namkha obuzakwalako bokufakazela lokho umsebenzi azabe akufunela iLifu yokuQala zomKhaya.

3.8  ILIFU ENGABHADALELWAKO 

3.8.1  ILifu engaBhadalelwako umuntu angayibawa ebujamweni obungakavami, futhi nala umuntu anganamalanga aneleko welifu yokuphumula. 
3.8.2   Umuntu angabawa iLifu engaBhadalelwako yamalanga alikhomba (7) wekhalenda ngomzombe munye welifu.
3.8.3   Iimbawo zeLifu engabhadalelwako zithunyelwa ku-Manager, Human Rsources, kobanyana ayozihlola bese uyozikhulumela esiKhulwini esiPhetheko namkha kesinye isiPhathiswa esijamele sona isiKhulu esiPhetheko kobanyana kube ngibo abazidlulisako. 
3.8.4   Nakube unikelwa iLifu engaBhadalwako edlula emalangeni alikhomba (7) womsebenzi, umsebenzi obawa ilifu leyo kuzakufanela ukuthi azibhadalele ngokwakhe isikhathi azabe aselifini ngasweso imali evame ukuthi ayiphoselelwe yiBhodi yezamaNzi yeKangala esiKhwameni sokuBekela, nesiKhwameni seTjhorense kunye nesiKhwameni sokweLatjha. 

 

4.	UKUTHOLAKALA KWABASEBENZI

4.1 UKUFUNWA, NOKUKHETHWA NOKUBEKWA EENKHUNDLENI

4.1.1	Boke abantu abenza iimbawo zomsebenzi zesikhundla esithileko bazakuqalelelwaa ngaphandle kokukhetha ubuzwe babo, ukuthi bababantu bani, ukuthi bamhlobobani nokuthi baphila ngakolelobani. Nokho-ke kuzakuvamisa ukuthi kuqalwe bekwenyulwe abantu esele vele basebenza khona eBhodini yezamaNzi yeKangala, futhi nebazizakhamuzi zeSewulaa Afrika, nngaphambi kobana kuqalwe abanye. 
4.1.2	Abantu abavela ngaphandle bazakutjhejwa kwaphela nakube akatholakali umuntu olungele isikhundla somsebenzeso ebasebenzini esele vele bakhona eBhodini yezamaNzi yeKangala. 
4.1.3	Zoke iinkhundla zomsebenzi zizakuthoma ngokukhangiswa ngaphakathi, kwenzelelwe ukubanikela ithuba ntanzi abasebenzi beBhodi abazilungeleko iinkhundlezo, ukuthi benze iimbawo. 

4.1.4	Nakufumaniseka ukuthi akatholakali umuntu olungele isikhundla somsebenzi ngendlela kuhlathululwe ngayo ku-4.1.2 ngehla, isikhundla somsebenzeso sizakukhangiswa ephephandabeni lesifunda. Nakubhalako nalapho, khona-ke kuzakukhangiswa ephephandabeni lelizwe loke. 

4.1.5	 Yi-Hunan Resources Manager ethwele umsebenzi wokufuna nokuthola abantu abafunelwa umsebenzi nanyana ngimuphi, nanyana bavela khona ngaphakathi nanyana bavela ngaphandle. 

4.1.6	 Iinkhangiso zomsebenzi, (nanyana ngezangaphakathi kwaphela nanyana ngezangaphandle), zitlanywa zihlelwe mNyango weHuman Resources ngokubambisana nomPhathi womNyango loyo la kunesikhundla somsebenzi khona. 

4.1.7	Iinkhangiso zomsebenzi kufuze bona ziveze bona yini okufuneka emsebenzini okhangiswako loyo. 

4.1.8	UmPhathi weHuman Resources nguye ozakunikela umPhathi womNyango othileko namkha esinye isiphathiswa esithunywe umsebenzi onjalo yoke imininingwana yomuntu ofbawa umsebenzi, kobanyana azokuqalwa ahlolwe ukuthi uwufanele na umsebenzi loyo.

4.1.9	 Zoke iinkhundla zomsebenzi zizakuvalwa ngokuvunyelwa yiBhodi, nangokuqala ukuthi ikhona na imali ezakusetjenziselwa isikhundleso. 

4.1.10	 Abantu beenkhundla eziphasi baqatjhwa baPhathi bemiNyango ngokwahlukana kwabo la kukhona khona iinkhundlezo, ukuqatjhwa kwabo-ke kupheleliswe ngokuvunyelwa siKhulu esiPhetheko. UmNyango weHuman Resources ngiwo ozakuba nesiluleko esizakwenza umPhathi womNyango namkha isithunywa sakhe sikghone ukuthatha isiqunto esifaneleko.

4.1.11	Ama-Supervisor nabaphathi beenkhundla eziphakathinaphakathi baqatjhwa asiKhulu esiPhetheko, ngokunikelwa amandla nguSihlalo weBhodi. 

4.1.12	 AbaPhathi beenkhundla eziphezulu (njengeGeneral Manager nangaphezulu) baqatjhwa yiKomidi yeBhodi ebekelwe ukuKhetha abaSebenzi abaFaneleko, ngokuvunyelwa yiBhodi ngokwayo.

4.1.13	 UmPhathi weHuman Resources nnguye ozakuthwala umsebenzi wokuphatha nokulawula koke okuphathelene nokuqatjhwa kwabantu, nokusebenza ngeembawo zomsebenzi ezingakaphumeleli.

4.1.14	 Umuntu uthathwa ukuthi selasebenza eBhodini le ukusukela ngelanga lokuthoma athoma ngalo ukusebenza, ngaphandle-ke kokuthi athome abekelwe ukuthoma ukusebenza ngelanga lokuthoma lomsebenzi enyangeni, kodwa kufumaniseke ukuthi ilanga lokuthoma lenyanga alisilanga lomsebenzi, ngaleyindlela-ke ilanga lokuthoma emsebenzini kuba ngilo lonelo lokuthoma lenyanga nanyana ingasisilo ilanga lomsebenzi njalo. 

 
4.2	AMATORHO 

4.2.1	Abasebenzi bangaqatjhelwa amatorho kobana bazokuphungulela abasebenzi abasebenza unomphela umsebenzi ngeenkhathi la kunomsebenzi omnengi khona khulu namkha ngeenkhathi zamahlelo akhethekileko. 
4.2.2	 Umuntuu otorhako akakwazi ukutorha ukudlula eenyangeni ezintathu (3) ngokulandelana, kanti godu umuntu obekatorha akakwazi ukubuyiselwa etorhweni kungakapheli inyanga yinye (1) aqede ukutorha khona la eBhodini yezamaNzi yeKangala. 
4.2.3	 Umuntu otorhako naye unamalungelo wokuthola boke ubuhle ekufuze butholwe mumuntu otorhako ngokwemibandela yomThetho oLawula Iindlela zokuSebenza kwabaSebenzi (I-Basic Conditions of Employment Act). 
4.2.4	Umuntu otorhako uqatjhwa mNyango weHuman Resources ngesibawo somPhathi womNyango la kufuenaka khona umuntu. 
4.2.5	Abantu bamatorho bazakuqatjhwa ngama-ofisi wezabaSebenzi wendawo la kukghonakala khona, nangezinye iindlela ezilungileko nezikghonakalako. 
4.2.6	 Abantu belwazi lamakghonofundwaa (Professionals) bazakuqatjhwa ngekontraga nakube kufuneka ilwazi labo. Amakontraga anjalo-ke abekelwe ukwenza umsebenzi othileko ngesikhathi esithileko.. 
4.2.7	 Abafundi abavela eendaweni zefundo ephakemeko banganikelwa ithuba lokwenza umsebenzi ofunwa ziimfundo zabo ukuqedelela indima abayifunda eencwadini, nakube kuyakghonakala ukuthi ilwazzi elifunekakwelo litholakale ngesikhathi umfundi azabe alapho ngaso. Amalungiselelo anjalo-ke kufuze ukuthi enziwe mPhathi womNyango, adluliswe siKhulu esiPhetheko namkha isithunywa saso, ngaphambi kobana abafundabo bangabhadalwa noba ngayiphi indlela. 

 
5.  UKUSETJENZISWA KWABASEBENZI 

 5.1 UKUTRANSFERWA KWABASEBENZI
 
5.1.1  IBhodi yezamaNzi yeKangala inelungelo lokutransferela umsebenzi kinanyana ngimuphi omunye umsebenzi ongaphasi kwayo, nakube kubonakala kuzayisiza lokho; lokho-ke nokho kwenziwa ngemva kokubonisana. 
5.1.2   Isibawo somsebenzi sokutransferwa sizakuqalwa ngosiqalelela nngobusona, sivunywe nakube lokho kuserhuluphelweni yeBhodi.
5.1.3   Umsebenzi otransferwe yiBhodi yezamaNzi yeKangala ngokulandela ikambiso eku-5.1.1 ngehla uzakuba nelitho aliliswa ngalo ngokukhisimezeka kwakhe ngokutransferwa, ngokuqalelela lokhu okulandelako: 

*  iindleko zokukhamba kwakhe ngokwakhe, nezokukhamba komndenakhe, kubalwe kungadluli emalangeni amabili (2), kunmgadluli neenkoloyini ezimbili (2).;
*  imali yesibonelelo sokuthutha elingana nomrholo wenyanga, eyimali yokuthenga amarhaideyini, ijinifomu yesikolo, njalo njalo, ngokuqala ubufakazi obutloliweko beendleko zalokho, njengokubekelwa yiBhodi.
*  iindleko zokukhambisa ifenitjhari (sekubalwe netjhorense); kodwa umbandela walokho kukuthi umuntu abuze ebathuthini befenitjhari abahlukeneko babe bathathu alinganise iindleko zabo zokuthutha; imali yabathuthi abakhethelwe ukuthutha ifenitjhari ngemva kwalokho kufuze bona ibikelwe umPhathi we-Human Resources ntanzi, yena-ke abe negama lokugcina lokuthi ngibaphi abathuthi abazakusetjenziswa. 5.2  UKUTHUNYELWA KOMUNYE UMSEBENZI 

5.2.1  IBhodi yezamaNzi yeKangala inelungelo lokuthumela umsebenzi nanyana ngimuphi komunye umsebenzi kelinye lama-ofisi wayo, ehlanganweni esambuso namkha emnyangweni karhulumende la umsebenzi loyo azakufike anzinze asebenzele khona. Lokho-ke kwenziwa ngokubonisana nomsebenzi loyo neYuniyoni yakhe namkha bobabili. 
5.2.2   Ikambiso evezwe ku-5.1.3 yomgomo lo izakusetjenziswa umsebenzi nakathuthako ngoba athunyelwe komunye umsebenzi, nakube uyokuhlala isikhathi esingaphezulu kweenyanga ezintandathu (6) emsebenzini omutjha namkha endaweni etja athunyelwe kiyo. 
5.2.3   Nakube lapho athunyelwe khona uyokuhlala isikhathi esingaphasi kweenyanga ezintandathu (6), iBhodi yezamaNzi yeKangala izazibhadalela iindleko ezifaneleko nezilungileko zendawo yokuhlala ngesikhatheso, ibhadalele neendleko zokukhamba ezilingana iimpelaveke ezimbili (2) ngenyanga yinye yekhalenda. 
5.2.4   IBhodi yezamaNzi yeKangala inelungelo ukumbuyisa umsebenzi ebeyimthumele komunye umsebenzi nanyana kukunini, umsebenzi loyo imbuyisele kesinye isikhundla somsebenzi esivulekileko esimfaneleko. 

5.3  UKUPHAKANYISWA ESIKHUNDLENI NOKUBAMBELA 

5.3.1  Nakube umsebenzi uphakanyiselwa esikhundleni esphezulu, umsebenzi wakhe wesikhundla esitjha uthoma ngelanga lokuthoma lenyanga elandela ilanga ekuvunywe ngalo ukuthi angaphakanyiselwa kiso.

6. UKUTHWASISWA NOKUTHUTHUKISWA

 Abasebenzi beBhodi yezamaNzi yeKangala nakufanele bona bathathe iimfundo zomsebenzi eziphathelene nemisebenzi abayenzako eBhodini le, IBhodi yezamaNzi yeKangala le ngiyo ezakuthwala iindleko zeemfundwezo; umuntu nakaya eemfundweni ezinjalo-ke kufuze azalise amaforomu wokuya eemfundweni ezinjalo, bese aqalwa abe avunyelwe ziimphathimandla ezifaneleko. 

7.  IHLELO LOMFUNDALIZE 

7.1  UMNQOPHO 

 (a). Umfundalize Wesikhathi Esizeleko

 Unqophe ukusebenza njengendlela yokufuna nokuthola abasebenzi emakorweni

7.2 INTLHOGEKO ZOMFUNDALIZE (okufunekako) 

7.2.1  IBhodi yezamaNzi yeKanngala ngiyo ezakubeka ukuthi mingaki imifundalize ezayikhupha, ikhethe nokuthi ngimaphi amakoro womsebenzi azakufundelwa ngemifundalize leyo, ngokuqalelela lokhu okulandelako: 

* umnqopho wehlelo lomfundalize;
*  ukutholakala kweemali, kunye
*  nezinga leembawo ezingenileko zibawa imifundalize. 

7.2.2  Umfundalize uzakunikelelwa amakoro womsebenzi iimfundo zawo ezitholakala eendaweni zefundo ezaziwako. Umuntu uzakuvunyelwa ukuyokufudna ngomfundalize emazweni wangaphandle kwaphela nakube ifundo efunekako leyo akukho la itholakala khona lapha eSewula Afrika. 
7.2.3   Ukuqalelelwa ukufundiswa ngomfundalize umuntu kufuze azalise amaforomu wokubawa umfundalize, azalise nesiVumelwana somFundalize. 

7.3  INANI LEMALI YOMFUNDALIZE

7.3.1  IBhodi yezamaNzi yeKangala ngiyo ezakuqala itjho nakufuneka kube nomfundi othwasiswako, bese ikhupha imali yomfundalize kenye nenye ikoro yeemfundo, ngokuqalelela iindleko zamambala ezifuneko efundweni enjalo, nezifuneka ekurejistareni, nezifuneka ekutlolweni kweenhlahlubo, kunye nezendawo yokuhlala, ngokunjalo nezeemfanelo neensetjenziswa zokufunda. 
7.3.2  Umfundi o ongalali ehostela yendawo yefundo afunda kiyo angabhanikelwa imali engephezulu eemali ezingeziphasi zehostela yendawo yefundo leyo. 
7.3.3   Umfundi anganikelwa nemali elitjhumi lamaphesente (10%) yemali yomfundalize ezakuba yimali yezinye iindleko ezingakabalwa ku-7.3.1 ngehla.
7.3.4   Kungenzeka kubekwe inani lemali yomfundalize elingazihlanganbisiko iindleko zoke ezifunwa ziimfundo, nakube isilinganiso seentlhogeko zomfundalize neemali ezikhona zitjho njalo. 

(b). Umfundalize Wesikhathi Sangahlanye

7.4  UKWAZISWA NGOMFUNDALIZE 

7.4.1  IBhodi yezamaNzi yeKangala ngiyo ezakutjho indlela ekuzakumenyezelwa ngayo amakoro wefundo anemifundalize ebafundini abafunda isikhathi esizeleko, ngokuqalelela itlhogeko yokuthi kutholakale abantu abakufanele mbala ukufundiswa ngomfundalize. 
7.4.2   Umfundalize wokufunda ngesikhathi sangahlanye unikelwa kwaphela abasebenzi beBhodi yezamaNzi yeKangala, hayi abantu bangaphandle. Ngalokho-ke basebenzi beBhodi le kwaphela abazakwaziswa ngomfundalize onjalo nawukhona. 


7.5  ABALUNGELE UKUBAWA UMFUNDALIZE 

7.5.1  IBhodi yezamaNzi yeKangala ngiyo ezakubeka indlela ekuzakumenyezelwa ngayo iimemo zabantu abafuna ukubawa umfundalize, ngombandela wokuthi umuntu ozakukhuluma ammala ngaye eforomini lesibawo somfundalize angeze asaqalwa nokuqalwa. 
7.5.2   Umfundalize ulungele boke abantu abazizakhamuzi zeSewula Afrika, kodwa namaphandle esele asebenza khona eBhodini yezamaNzi yeKangala nabo bangaqalelelwa. 
7.5.3   Umuntu nakazakuthola umfundalize, kufuze ukube naye uyayizalisa imibandela yokwamukelwa kwabafundi endaweni yefundo afuna ukuyokuraga ifundo yakhe kiyo.
7.5.4   Iimbawo zomfundalize ebantwini abaqhwalileko kufuze bona ziqalwe ngelihlo elifanako nabantu abaphilileko, ngaphandle-ke kokuthi mhlamunye umfundalize wenzelwe bona kwaphela abantu abaqhwalileko.
7.5.5   Ukuthi umuntu uphile njani, nezinye iintlhogeko iBhodi eziqala umuntu nakaqatjhwako zizinto ekufuze bona iziqale nanyana umuntu aqalelelwa ukuphiwa umfundalize. 


7.6  UKUHLOLWA KWABABAWI BOMFUNDALIZE 

 (a). Umfundalize Wesikhathi Esizeleko 

7.6.1  IBhodi yezamaNzi yeKangala ngiyo ezakubeka iindlela ekuzakuqalwa ngazo iimbawo zomfundalize; nokho kuzakuqalwa khulu khulu ukuthi umuntu usebenza njani eemfundweni zakhe nakuqalwa isibawo. Ukusebenza isikhathi eside eBhodini yezamaNzi yeKangala nakho kungaqalelelwa (ngoba phela kusitjengiso sokuthi umuntu loyo uthembeke kangangani eBhodi)). 
7.6.2   Nakube kukhona la kunokuzaza khona ngokuthi umfundi ukufanele ukuthola u7mfundalize namkha awa, kungafuneka kubanjwe ikulumiswano yokusefa; nokho-ke nakwenziwa njalo kufuze bona kuqalisiswe neendleko ezikhambisana nalokho; kesinye isikhathi kungenziwa nokuthi iindleko zekulumiswano yokusefa leyo zibhadalelwe yiBhodi yezamaNzi yeKangala. 
7.6.3   Abasebenzi beBhodi yezamaNzi yeKangnala ababawa ukuphiwa umfundalize wesikhathi esizeleko kuzakufanela ukuthi baphalisane nabanye ababawi bomfundalize abavela ngaphandle. 
7.6.4   Ukukhethwa kwabantu abalungele ukuphiwa umfundalize kufuze ukuthi kukhambisane nesibopho sokuziphendulela emphakathini. 
7.6.5   Umsebenzi kufuze bona abe nawo amandla wekghono lokuphumelela eemfundweni aazibawela umfundalize, futhi kufuze nokuthi athathwe njengegugu elikuzibekela kwangomuso eBhodini yeKangala le. 
 
7.7 IMIBANDELA YOKUSEBENZISA UMFUNDALIZE 

7.7.1  Imibandela yokusetjenziswa kwemifundalize ibekwa yiBhodi yezamaNzi yeKangala, ngombandela wokuthi umuntu ofundiswa mfundalize weBhodi le uzakkutlikitla isivumelwana sokufunda ngawo umfundalize lo, futhi nakaqeda ukufunda asebenze eBhodini le isikhathi esilingana nesikhathi afundiswe ngaso ngomfundalize, nakube bekafunda ngomfundalize wesikhathi esizeleko. Ebantwini abafunda ngomfundalize ngesikhathi sangahlanye, iBhodi izakubeka ukuthi nabaqeda ukufunda bazakufanela ukuthi basebenze isikhathi esingangani eBhodini ngaphambi kobana bangatjhaphuluka ukuthi baophume nakube bafuna ukuya laphokhunye; lapha-ke kuzakuqalelelwa nokuthi umuntu ofunda ngomfundalize loyo besele asebenze isikhathi esingangani eBhodini; abanye abasebenzi esele basebenze isikhathi esaneleko eBhodini, angeze babe nesibopho sokusebenza isikhathi esilingana nesikhathi abafundiswe ngaso ngomfundalize, nabaqeda ukufunda. 
7.7.2   Umuntu nakathola umfundalize ubekelwa isikhathi esibuncani bokuqeda isifundo ayosifunda, namkha isikhathi esibuncani esiseleko sokuqedelela isifundweso, nakube besele sithonyiwe. Abantu abaphiwe umfundalize kufuze bona balandele iimfundo ezikulu abanzinze ngazo eemfundweni zabo (major courses) ezibekwe yiBhodi, futhi kufuze ukuthi iimfundo zabo baziqede ngesikhathi esibekiweko sokuqeda iimfundwezo.
7.7.3   Umuntu ofunda ngomfundalize nakabuyelela iimfundo ebesele iBhodi izibhadalele kuzakufanela bona azibuyelele ngeendleko zakhe. 
7.7.4  Iimfundo zokufunda ngokwenza ezifunwa yindawo la umfundi ofunda ngomfundalize afunda khona kufuze bona zenziwe ngokukhulumisana hlangana komfundi neBhodi. 
7.7.5   Iiskhathi umuntu azabe angekho ngaso emsebenzini ngoba aseemfundweni zakhe, namkha alungisela ukuyokutlola iinhlahlubo kufuze bona sisetjenzwe ngekambiso esebenza eBhodini malungana nelifu yokungabikho emsebenzini. 

7.8  AMAGADANGO WOKUCHIBIYELA 

 Abantu abafunda ngomfundalize weBhodi namkha abasendleleni yokuyokufunda ngawo, engeze umfundalize wabo usabuyiselwa emva, futhi ubujamo babo obungakhisimezekae ngokubuyekezwa komfundalize wabo ngokwemibandela ela, bazakuragela phambili ngomfundalize wabo ngokuqalelelwa umuntu ngamunye ngesiyena. 
 
7.9  OKUNGAKAVAMI NAMATJHUGULUKO

 (a). Abasebenzi abaseenkhundleni ze-HAY ye-392 nangaphezulu balungele ukuthola isibonelelo seenkoloyi ngenyanga, esisetjenzwe ngesilinganiso seemakethe sangesikhatheso. Abanye abasebenzi umsebenzabo obenza ukuthi bavame ukukhamba ngomsebenzi nabo bangafakwa ehlelweni lesibonelelo seenkoloyi elibafaneleko namkha banikelwe iinkoloyi zefemu abazakukhamab ngazo nabayokusebenza. 
 (b). Abasebenzi abasehlelweni lokubonelelwa ngeenkoloyi banesibopho sokuqiniseka ngeenkhathi zoke ukuthi iinkoloyi abakhamba ngazo zihlala ziqaleka kuhle, zihlanzekile, zingoni isithunzi negama elihle leBhodi yezamaNzi yeKangala. 
 (c). Imali yesibonelelo sekoloyi ibhadalwa ngenyanga nomrholo womsebenzi ojayelekileko, ngemva kokudosa iindleko zekoloyi ezifaneleko umsebenzi azikweleda iBhodi. 
 (d). Imali yesibonelelo sekoloyi isebenza lokhu: 

 IINDLEKO EZINZILEKO
* Imali umuntu ekufuze ayibhadale ngenyanga yekoloyi leyo, ngokwesilinganiso sesikhundla sakhe somsebenzi;
*  Imalinzalo neendleko zokuthenga ngesikwelede, ngokwesilinganiso esisebenza esikweledeneso;
*  Iindleko zokurejistara nezokubhadalela ilayisense yekoloyi;
*  Imali yetjhorense. 

 IINDLEKO EZITJHUGULUKATJHUGULUKAKO 
*  Iindleko zokusetjenziswa kwekoloyi zokuthela ipetroli, nezokuseviswa kweloyi, kunye nezokuyondla, ngokwesilinganiso esifaneleko. 

 (e). Imali umuntu abonelelwa ngayo iyatheliswa, njengoba kusitjho umthetho wezomThelo. Iindleko ezinzinzileko zizakubalwa isikhathi esiminyaka emine, ngaphandle kokukhetha ukuthi kube namatjhuguluko bani ekoloyini leyo ngesikhatheso. 

8.1.2  IMALI YOKUTHENGA 

 Kungaba yiBhodi yezamaNiz yeKangala ekhupha imali yokuthenga ikoloyi ezakukhamba ngomsebenzi, namkha kwenziwe amalungiselelo wokuthi ithengwe yibhanga ikoloyi leyo, ngesivvumelwana sokubuyisa imali ekuthengwe ngayo nemalinzalo yakhona ngesikhathi esiziinyanga ezimatjhumi amanenobunane (48). Nakuthenga iBhodi yezamaNzi yeKangala, imalinzalo yakhona izakubalwa ngesilinganiso esisetjenziswa ziinkhamphani ezithengako, kanti-ke nakuthenga ibhanga, imalinzalo yakhon izakuba ngneyemabhanga. 

8.1.3  AMAKHAMBO WANGEQADI

8.1.4  UKUKHETHWA KWEENKOLOYI 

 Umuntu akakalinganiselwa ukuthi angakhetha yiphi ikoloyi azakukhamba ngayo. 

Abasebenzi abasehlelweni lokubonelelwa ngeenkoloyi kufuze ngesikhathi soke baqinisekise ukuthi iinkoloyi abazikhethako ziwufanele beziwulungele umsebenzi abawenzako, bakhumbule nobujamo bendawo abasebenzela kiyo, ngoba umuntu othengelwe ikoloyi ngehlelo lokubonelelwa ngekoloyi yomsebenzi angeze anikelwe ikoloyi yefemu esetjenziswa babantu abanganazo iinkoloyi zomsebenzi ngenca yokuthi ikoloyi yomuntu loyo ayikghoni ukumusa la kufuze imuse khona. 
Abasebenzi abathomako ukungena ehlelweni lokubonelelwa ngeenkoloyi ngehlelo lokubonelelwa ngeenkoloyeli, bangathatha iinkoloyi ebebavele banazo bazifake ehlelweneli, ngokulawulwa mibandela esemtlolweni lo. 
IBhodi yezamaNzi yeKangala inelungelo lokuyikhupha ikoloyi esetjenziswa nanyana ngimuphi umsebenzi nakubonakala ukuthi ikoloyi leyo ayikawulungeli usmebenzi owenziwa msebenzi loyo, namkha nakubonakala ukuthi ubujamo bayo nokuqaleka kwayo kuthuna isithunzi negama elihle leBhodi. 

8.1.5  IINDLEKO ZOKUSEBENZA

10. OKHUNYE 

10.1  ISIKHATHI SOMSEBENZI 

10.1.1  Isikhathi somsebenzi esisemthethweni kibo boke abasebenzi bezokuphatha nezokulawula matjhumi amane wama-awa (40) ngeveke, ukusukela ngomVulo ukuyokufika kuLesihlanu, sekubalwe nesikhathi setiye, kodwa ngaphandle kwesikhathi sedina. 10.1.2   Isikhathi somsebenzi esisemthethweni sabasebenzi bechwephetjhe, amapoperator nabanye abafana nabo abangasebenzi amatjhifu simatjhumi amanenahlanu wama-awa (45) ngeveke, ukusukela ngomVulo bekuyokuba ngeLesihlanu, sekubalwe nesikhathi sokudla idina. Isikhathi setiye kilababasebenzi ngu-09:00 ukuyokufika ku-09:15, kanti-ke idina lona lidliwa ngo-12:00 ukuyokufika ku-12:30. 10.10.7   Umsebenzi kulilungelo lakhe ukujoyina ihlangano yezabasebenzi ayithandako, kodwa iBhodi yezamaNzi yeKangala izakwenza isivumelwana sokusebenzisana namayuniyoni/neenhlangano zabasebenzi enesivumelwana sokusebenzisana nazo kwaphela. 
10.10.8  Abasebenzi kufuze ngaso soke isikhathi baziphathe ngeendlela ezilungileko nezivumakalako.
10.10.9   Akunamsebenzi ovunyelwe ukuza notjwala emsebenzini, futhi akakho ovunyelwe nokuphatha utjwala emabaleni womsebenzi.

4.   Isiko lokukhalinywa liyafuneka umsebenzi nawuzakwenziwa ngendlela ehle nephumelelako, nabasebenzi nabazakuphatheka kuhle, futhi liqinisekisa nokuthi abasebenzi: 

 (a). balalelwa bagwetjwe kuhle ekundleni yokulalela;
 (b). babikelwa ngesikhathi ngezwangobatjho yokungaziphathi kuhle ezwakala ngabo;
 (c). bayatlolelwa iinzathu zegadango abathathelwe lona, futhi 
 (d). banelungelo losidlulisela phambili isiqunto esithethwe ngabo nasingabanelisiko.

 (a). Ukuthi lokho ekulilwa ngakho kwenze monakalo muphi, nongangani emsebenzini weBhodi yezamaNzi yeKanngala, naphezu komsebenzi loyo ngokwakhe, naphezu kwabanye abasebenzi asebenza nabo kunye naphezu komphakathi. 
 (b). Ukuthi umsebenzi loyo usebenza umsebenzi onjani, nokuthi yini iimbopho zakhe zomsebenzi.
 (c). Ubujamo bezinto umsebenzi loyo enze icala ekuthiwa ulenzilelo, kunye 
 (d). nokuthi kube nenngozi engangani ekuphepheni komsebenzi loyo ngokwakhe, naphezu kwabanye abasebenzi asebenza nabo, kunye naphezu kweBhodi yezamaNzi yeKangala ngokwayo. 

E.  IKAMBISO: AMAGADANGO WOKUKHALIMA

 Nakube umsebenzi wone khulu kangangoba kufuneka nokuthi akhuzwe ngokuyalwa (counselling) umphathi womsebenzi loyo kufuze: 
 (a). Atjele umsebenzi loyo ngakonileko.
 (b). Athole iinzathu ezenze umsebenzi one, bese unikela umsebenzi loyo ithuba lokuziphendulela ngezwangobatjho ezwakala ngaye.
 (c). Afune iindlela ekunbgavunyelwana ngazo zokurarulula umraro loyo.
 (d). Athathe amagadango wokuphumelelisa ihlelo ekuvunyelwenwe ngalo elizakulandelwa. 

2.  Ukuyeleliswa Nngomlomo 

 Nakube umsebenzi wone ngnendlela yokuthi kufuneka ayeleliswe ngomlomo, umphathi wakhe kufuze amyelelise umsebenzi loyo ukuthi nangangona njalo godu uzakuqiniselwa isandla sokukhalinywa, athi angenza njalo bese uyasitlola isiyelelisweso. 

3.  Isiyeleliso Esitloliweko 

 Nakube umsebenzi wone ngendlela yokuthi kufuneka ayeleliswe ngencwadi, umphathi wakhe kufuze bona amnikele isiyeleliso esitloliweko. Sikhanjiswa nje-ke isiyeleliso esitloliweko: 
 (a). Singasebenzisa iforomu lesiHlomelelo B.
 (b). Umphathi kufuze bona anikele umsebenzi ikhophi yesiyeleliso esitloliweko ayeleliswa ngaso, bese umsebenzi-ke uyasitlikitla. Nakube umsebenzi uyabhala ukusitlikitla isiyeleliso, umphathi kufuze bona anikele umsebenzi loyo isiyeleliso esitloliwekweso phambi komunye umsebenzi ozakuba ngufakazi, bese uyatlikitla ukufakazela ukuthi isiyeleliso umsebenzi loyo unikelwe. 
 (c). Isiyeleliso esitloliweko kufuze bomna sifakwe efayeleni yomsebenzi loyo.
 (d). Iisiyeleliso esitloliweko sihlala iinyanga ezintandathu (6). Ngemva kwalokho isiyelelisweso kufuze bona sikhutjhwe efayeleni yomsebenzi, sidatjulwe. 
 (e). Nakungenzeka kuthi kkungakapheli iinyanga ezintandathu umsebenzi ayeleliswe ngencwadi bese umsebenzi loyo uba necala elifuna akhalinywe godu,isiyelelisweso singahle sibalwe naso nakagwetjwako namkha nakakhalinywako. 

4.  Isiyeleliso Sokugcina Esitloliweko 

 NAKUBE icala lomsebenzi lifuna ukuthi atlolelwe isiyeleliso sokugcina, umphathi anganikela umsebenzi loyo isiyeleliso sokugcina esitloliweko. Sona-ke isiyeleliso sokugcina esitloliweko sikhanjiswa ngalendlela: 

 (a). Singasebenzi iforomu lesiHlomelelo C. 
 (b). Umphathi kufuze bona anikele umsebenzi owonileko ikhophi yesiyeleliso sokugcina esitloliweko, bese uyasitlikitla umsebenzi isiyelelisweso. Nakube umsebenzi uyabhala ukusiltikitla isiyelelisweso. umphathi kufuze anikele umsebenzi loyo isiyelelisweso phambi komunye umsebenzi ozakuba ngufakazi, bese uyatlikitla ukufakazela ukuthi isiyeleliso sokugcina esitloliweko unikelwe umsebenzi loyo. 
 (c). Isiyeleliso sokugcina esitloliweko kufuze sifakwe efayelini yomsebenzi loyo. 
 (d). Isiyeleliso sokugcina esitloliweko naso sihlala iinyanga ezintandathu (6). Ngemva kwalokho isiyeleliso sokugcina esitloliwekweso kufuze sikhutjhwe efayeleni yomsebenzi, sidatjulwe. 
 (e). Nakungenzeka kuthi kungakapheli iinyanga ezintandathu (6) umsebenzi ayeleliswe ngesiyeleliso sokugcina esitloliweko bese umsebenzi loyo uba necala elifuna akhalinywe godu,isiyelelisweso singahle sibalwe naso nakufunwa iswazi angakhalinywa ngalo ekugwetjweni kwakhe. 

5.  Nakube umsebenzi akoni khulu, akunafuneko yokuthi kubizwe ibandla elihlelekileko lokugweba. 
6.   Nakuqalwa ukuthi umsebenzi owonileko angathathelwa gadango bani, iinyeleliso ezisasebenzako zamacala aafanako - nazikhona - ziyaqalwa nazo. 


F.  ICALA ELIMBI 

1.  Nakube umsebenzi wone ngendlela embi efuna ukuthi athathelwe amagadango anzima wokukhalinywa ukudlula la esiwabale ngehla, umqatjhi angavula ikundla yokuphenya ngezwangobatjho yokona komsebenzi loyo. Umqatjhi kufuze bona akhethe umjameli ozakuvula ikundla yokuphenya nokugwetjwa leyo; umjameli loyo kufuze bona kulingwe ngazo zoke iindlela ukuthi abe mphathi womsebenzi owonileko. 

G.  IPHENYO LOKUKHALIMA 

1.  INOTHISI YEPHENYO LOKUKHALIMA 

 (a). Umsebenzi kufuze bona anikelwe inothisi kusasele amalanga amathathu womsebenzi - ubuncani bakhona - ngaphambi kwelanga ekufuze kuyokuhlangana ngalo ikundla yokuphenya ngalo icala lokukhalima. 
 (b). Umsebenzi kufuze bona ayitlikitle inothisi anikelwa yona. Nakube umsebenzi uyabhala ukutlikitla inothisi yecala, kufuneka anikelwe yona phambi komunye umsebenzi abasebenza naye, yena-ke ozakutlikitlela ukufakazela ukuthi umsebenzi onecala unikelwe inothisi. 
 (c). INothisi etloliweko yephenyo lokukhalima kufuze iserbenzise iforomu lesiHlomelelo D. Inothisi-ke ijama nje: 

 (i). Ihlathulula izwangobatjho yecala elibekwa umsebenzi, nobufakazi obukhulu umqatjhi azakusimelela kibo;
 (ii). Itjho ilanga, isikhathi nendawo la kuzakuhlanganela khona ikundla yephenyo lokukhalima,
 (iii). Itjele umsebenzi ngelunngelo lakhe lokuba nomuntu ozamjamela, ongaba ngomunye umsebenzi abasebenza naye namkha kube mjameli ovela kuyuniyoni ejamele abasebenzi eyaziwako nenesivumelwana sokusebenzisana neBhodi, imtjele nangokuthi angaletha abofakazi bakhe ecaleni. 

2.  UKUJAMISA EMSEBENZINI NGOKUYELELA

 (a). Umqatjhi angamjamisa emsebenzini umsebenzi nomrholwakhe opheleleko, namkha amtransfere, nakube : 

i.  umsebenzi loyo kuzwakala ukuthi wenze icala elimbi; namkha nakube 
ii.   umqatjhi ukholwa ukuthi ukuba khona komsebenzi loyo emsebenzini kungahle kuliye iphenyo ngezwangobatjho ngaye, namkha kufake abanye abantu engozini namkha kufake ipahla yeBhodi engozini. 

 (b). Ukujanyiswa emsebenzini ngalendlela kuligadango lokuyelela elingatjho nokho ukuthi umsebenzi ojanyisiweko loyo vele icala selimlahlile, ngalokho-ke umsebenzi ojanyiswe njalo emsebenzini kufuze athi asekhaya njalo abe arhola umrholwakhe uphelele. 
 (c). Nakube umsebenzi ujanyiswe emsebenzini njengegadango lokuyelela, kufuze umqatjhi abize ikundla yephenyo lokukhalima kungakapheli amalanga amatjhumi amabili-nanye (21) womsebenzi. Ngemva kwalokho-ke sekunguSihlalo weBandlelo ongaqunta ukuthi ngokutshwila nakube liyatshwila. 

3.  UKURAGWA KWEKUNDLA YEPHENYO LOKUKHALIMA 

a.   Ikundla yephenyo lokukhalima kufuze ibizwe kungakapheli itjhumi lamalanga ngemva kobana inothisi yecala inikelwe umsebenzi ekuthiwa wonile.
b.   USihlalo weKundla kufuze abe msebenzi wesikhundla esiphezulu kunesomsebenzi obizelwe ebandla. Nakube umsebenzi obizelwe ebandla siKhulu esiPhetheko namkha nakube sikhulu esingamele umNyango, uSihlalo wekundla leyo kuzakufuneka kube nguSihlalo weBhodi namkha omunye umuntu onelwazi elifaneleko othunyelwe yiBhodi.
c.   Umsebenzi obizelwe ebandla nakafunako angajanyelwa ngomunye umsebenzi abasebenza naye, namkha ajanyelwe mjameli weyuniyoni enesivumelwana sokusebenzisana neBhodi. 
d.   Kungabizwa notoligi nakufunekako. 
e.   Ekundleleni enje umqatjhi, ngokufanako nomsebenzi, abakwazi ukujanyelwa ligcwetha. Kilomtlolo-ke nakukhulunywa ngegcwetha kutjhiwo isazimthetho esisebenza njenge-advocate namkha njenge-attorney eSewula Afrika.

h.   USihlalo uthoma ngokufunda inothisi ntanzi ngaphambi kobana ithome ukulalela ubufakazi ikundla. 
i.   Umjameli womqatjhi nguye-ke ozakuthula ubufakazi ngezwa ngobatjho eyenze bona umsebenzi abe abizelwe ebandla. Umsebenzi obizelwe ebandla, namkha umjamelakhe, angamtjhuka ngemibuzo ufakazi namkha bofakazi abangeza nomjameli womqatjhi. 
j.   Umsebenzi-ke naye uzakkunikelwa ithuba lokuveza bakhe ubufakazi. Umjameli womqatjhi naye-ke angamtjhuka ngemibuzo ufakazi womsebenzi namkha abofakazi bakhe.
k.   USihlalo angabuza nanyana ngimuphi ufakazi imibuzo yokuhlathulula nokukhanyisa lapha afuna khona umkhanyo uSihlalo lo. 
l.   Nakube uSihlalo ubona ukuthi umsebenzi nangambala unecala, kufuze amtjele umsebenzi loyo ngalokho, atjho nokuthi kungani ambona anecal. 
m.   Ngaphambi kobana kuthathwe isiqunto sokuthi ubethwa ngaswazi bani umsebenzi nakube ulahlwe licala, iuSihlalo kufuze anikele umsebenzi ithuba lokukhulumela ukuthi angabethwa ngeswazi elibuhlungu khulu. Nomjameli womqatjhi naye angaveza ubujamo obuthuwelelisa icala. 
n.   USihlalo-ke kufuze bona isiqunto sakhe sokugcina ngecaleli asibikele umsebenzi kungakapheli amalanga amahlanu womsebenzi ngemva kokuphela kokulalelwa kwephenyo lokukhalima, kanti-ke umphumela loyo kufuze bona ufakwe efayeleni yomsebenzi loyo. 

4.  ISIGWEBO 

a.  Nakube uSihlalo uthola ukuthi umsebenzi wonile, kufuze ukuthi akhuphe isigwebo amthwesa sona. Ngokuqala ukuthi umsebenzi woneni, nokuthi wone kangangani, nangokuqala amarekhodi waphambilini womsebenzi nokuqala ubujamo obungezelelele ukwenzeka kwecalelo, iingwebo zingaba: 

i.  kuyeleliswa ngokukhuzwa (counseling); 
ii.   siyeleliso esitloliweko; 
iii.  siyeleliso sokugcina esitloliweko;
iv.  ukujanyiswa emsebenzini nomrholo opheleleko isikhathi esingadlulileko eenyangeni ezintathu;
v.  ukwehliswa esikhundleni somsebenzi;
vi.  ihlanganisela yalokhu okungehla, namkha 
vii.  ukuqotjhwa. 

b.  Nakube umsebenzi uyavuma, uSihlalo angagweba umsebenzi ngokumjamisa emsebenzini ngaphandle komrholo, nankha amehlise esikhundleni somsebenzi kunobanyana amqotjhe. Nakube umsebenzi wehliswa emsebenzini, ngemva komnyaka angenza isibawo sokubuyiselwa esikhundleni ayekiso phambilini, ngaphandle kokuqatjhazelwa licala akhe aba nalo. 
c.   Umqatjhi akakwazi ukwethula isigwebo ukube umsebenzi icala lakhe usalidlulisele phambili. 

H.	UDLULISELWA KWESILILO SECALA PHAMBILI

Nasizizwa siphatheke kumbi isisebenzi, sifanele sibawe ukukhulumisana nomphathi waso poro msinyana ngokunokwenzeka.  Umphathi lowo uzakukhulumisana nesisebenzi ezikhathazekile phakathi kwamalanga amabili wokusebenza emva kokwenza isibawo leso alinge ukuveza intatha engamukeleka ngemva kokulalelisisa isililo sakhona.

12.	UKUPHUNGULA NOKUPHELA KOMSEBENZI

	12.1	Isingeniso	

	Umkhandlu lona uthatha ukusebenza kwasafuthi njengobukhozi basafuthi hlangana nomqatjhi kanye nesisebenzi.  Nakhiba isikhundla esithile ngesesikhathi esifitjhani, uMkhandlu uzakulinga ukuvala iskhundla leso ngesivumelwano sesikhatjhana namkha ngokumupha itorhwana umuntu isikhatjhana esithile.  Umkhandlu uzakuthi emajamweni ajayelekileko ulinge ukuphepha ukuphungulwa kwabasebenzi nokuphelelwa ngumsebenzi kwabantu, kodwana nakungaphepheki, kuzakusetjenziswa iinkambiso ezilandelako. 	12.2	Iinhlathululo

	Ukuphungulwa kweensebenzi ngokujayelekileko kuzakwenziwa nakufuneka bona uMkhandlu uphungule iinsebenzi ngamabanga wobujamo bomsebenzi.  Amabanga lawo angathinta, hlanga nokhunye, ukuvalwa kweenkoro ezincani zokusebenza nakhiba imisebenzi yakhona iginywa yihlelo elinabile.  Ebujamweni lobu ke abantu abathintekako bangahle bafuneke godu emva kwesikhathi nakhiba imisebenzi yoMkhandlu iyanda namkha kuvuleke iinkhundla.

	Ukuphelelwa ngumsebenzi kuvame ukwenzeka lokhwa, ngokuthuthuksa kobuchwephetjhe, umuntu angasafuneki ukwenza umsebenzi othile.  Nakwenzeka umsebenzi wenziwe ngumtjhini namkha ungasatlhogeki umsebenzi lowo, umsebenzi lowo uvalelwa futhi kuthi umuntu ogade awenza ke afakwe komunye umsebenzi.


	12.3	Amagadango afanele alandelwe

	Iimphathimandla nazibona ingathi kuzakufuneka kubikwe imemela lokuphungula namkha lokuphela komsebenzi, amagadango alandelako lana afanele enziwe;
       *	Kucalisiswe iindlela zokungaphepha ukuphungulwa kweensebenzi;
* Isaziso samsinyana serhuluphelo yokuphungula namkha sokubika ukuphela komsebenzi
*	Ukubikela iinhlangano namabumbano ajamelele abasebenzi;
*	Ukubonisana/ukukhulumisana neensebenzi nabajameleli bazo abayiinhlangano;
*	Ukuthobela umThetho wezokuPhatheka ngeFanelo emSebenzini(Basic Conditions of Employment Act)TPFS(BCEA) kanye/namkha isiVumelwano somSebenzi sesisebenzi ngasinye esithintekako;
       *	Kusetjenziswe indlela yokukhetha abaphungulwako;
*	Kuxoxisanwe neensebenzi ezizokuthintwa ngukuphungula namkha ngukuphelelwa ngumsebenzi.







12.	UKUPHUNGULA NOKUPHELA KOMSEBENZI


12.4	Iindlela zokukukhandela

Kuyindiba yoMkhandlu lo ukuluka amaqhinga azakuba nomphumela wokukhandela, namkha okungasenani wokurhunyeza ifuneko yokuphungula iinsebenzi.  Amaqhinga lawo afanele asetjenziswe ngokubonisana neensebenzi nangokwazisa iinhlangano ezijamelele abasebenzi.  Kungakhe kucalisiswe amagadango alandelako kodwana irherho leli alifanelanga lithathwe njengeliphelele namkha elihlukile.

*	Ukuthunyelwa kwamanye amaziko osebenzela kiwo uMkhandlu;
       *	Ukungasasebenzi isikhathi esengeziwe;
       *	Ukusebenza isikhathi esincani ngomrholo omncani eensebenzini ezifaneleko;
*	Kuvalwe ukuqatjhwa kwabantu bangaphandle ngaphandle kwabafundele imisebenzi abangaqatjhwa nguMkhandlu lo;
*	Ukwenza amalungiselelo neminye imiKhandly yaManzi/namabubulwana aseduze ukuqatjha iinsebenzi ezithintekako; kanye
       *	nokuvula amathuba womhlalaphasi wamsinya.


      12.5	Ukwazisa nokuBonisana

Umkhandlu lo uzakwazisa iinsebenzi neenhlangano ezibajamelele msinyana ngemva kokulemuka bona ukuphungula namkha ukuphela komsebenzi kungahle kufuneke.  Isaziso lesi sizakubikelwa iinsebenzi zoke okunganani isikhathi esingangenyanga yekhalenda ngaphambi kobana izaziso ziphiwe iinsebenzi ezizokuthinteka.  Ekukhambeni kwesikhathi esizako leso umKhandlu neenhlangano ezihlukeneko zabasebenzi ifanele ibonisane neenhlangano zoke ezithintekako ukusebenzisa iindlela zokukhandela ezibalwe ngehla ukufikela ezingeni ekuvunyelanwa kilo bona akusekho okhunye okungenziwa ukuphepha ukuphungulwa kweensebenzi nokuphela komsebenzi.  Ukuphela komsebenzi kuzakwenziwa esikhathini esingasingaphasi kwamalanga angamatjhumi amathathu wekhalenda wemva kokwaziswa ngencwadi kwesisebenzi.
















12.	UKUPHUNGULA NOKUPHELA KOMSEBENZI


12.6	Ukutholisisa iinsebenzi ezithintekako

Amaqiniso alandelako lana afanele acalisiswe nakuquntwa bona ngiziphi iinsebenzi ezifanele ziphungulwe.  Ngesikhathi sokubonisana, kufanele kutholisiswe bona ngiwaphi wamaqiniso lana afanele asetjenziswe godu nesisindo sokuzwakala kweqiniso ngalinye.  Irherho elingenzasi lapha litjengisa bona kusemajamweni anjani lapho amanye wamaqiniso lana angacalisiswa khona.  (Irherho leli njengoba lilapha alenzelwanga bona liwalamanise ngokuqakatheka namkha ngokulamana)

Iimphathimandla zizakwenza irherho leensebenzi ezizokuthintwa ngukuphungula namkha ngukuphela komsebenzi okuzako, kusetjenziswa ngokuqinileko amaqiniso azwakalako ekuvunyelenwe ngawo.  Iimali ezifanele iinsebenzi lezo zifanele zibalwe, kufakwa neemali ezivela eenkhwameni zomhlalaphasi, amalanga wokuphumula aselakhona, njll.  Imibiko leyo izakuthathwa njengeyisiphiri befuthi angeze yamane yaziswa muntu.


12.7	Ukuxoxisana neenSebenzi eziThintekako

Iimphathimandla zizakwenza amalungiselelo wokuthi iinsebenzi ezithintekako zixoxisane, ngasinye, noMininjara wezaMandla weenSebenzi namkha nesiphathiswa esibekwe nguye.  Isisebenzi singazikhethela ukuba nomjameleli waso ngesikhathi kuxoxisanwa.  Nakuxoxisanwako isaziso sokuphungulwa namkha sokuphela komsebenzi sizakuphiwa isisebenzi sitloliwe befuthi sitjho nelanga lokuphela komsebenzi nemali ezakuphiwa isisebenzi leso.  Isisebenzi namkha umjameleli waso uzakuba nethuba lokubuza malungana nemali enikezwako.  Bazakuthola nethuba lokwazisa uMininjara wezaMandla weenSebenzi ngamajamo angavamanga abawabona ingathi angathinta isiqunto sokuphelisa umsebenzi wesisebenzi leso.


12.8 Ukubuyekeza

Iimphathimandla zizakubuyekeza ukuphungulwa kweensebenzi ezazivezela iinlilo.
