UmThethosisekelo weSewula Afrika (iSahluko 10) ufuna ukuthi iKoro yabaSebenzi bomBuso:

1.	ISETHULO 

IKomitjhini yabaSebenzi bomBuso inikelwe amandla ngokomThethosisekelo ka-1996, ukukhuthaza nokwenza ukuthi izinga lomthetho wokuziphatha kwabasebenzi bemisebenzi efundelweko kiyo yoke iKoro yabaSebenzi bomBuso lihlale liphezulu. Ngo-1997 kwabethwa umThetho weRhelo lokuziPhatha eKorweni yemBuso, kwathi ngemva kwalokho waziswa kurhulumende omkhulu nakiborhulumende bamaphrovinsi. Kwafuneka nokuthi kutlanywe ikomba ngeRhelo lokuziPhatha kobanyana woke umuntu azolizwa kuhle, lona nokusetjenziswa kwalo, nakho koke elikhambisana nakho. 

Egameni leKomitjhini yabaSebenzi bomBuso, ngizizwa ngihloniphekile ukwethulela zoke iimphathimandla ezisebenza embusweni weSewula Afrika leNcwajana Ehlathulula Ngerhelo Lokuziphatha Labasebenzi Bombuso. Irhelo lokuziPhatha liyisika eqakatheke khulu ehlelweni elihle lokubusa nelokuziphatha kuhle kwabasebenzi bembusweni. Isikweli lithinta neendaba ezinjengokuhlonitjhwa kwamalungelo wobuntu, ukusebenza komthetho, isibopho sokuziphendulela kilokho umuntu akwenzekako, ukwenzela izinto emkhanyweni kurhulumende, ukuziphatha komuntu kunye nekareko yangeqadi. 

IKomitjhini yabaSebenzi bomBuso ibawa boke abasebenzi bombuso, ukusukela komncani ngesikhundla ukuya kosesikhundleni esiphezulu kinabo boke, ukuthi batjengise ukuzwisisa ikambiso, nemilayelo kunye nemilayo ephethwe liRhelo lokuziPhatha. Lokhu-ke akusinto ekghonakalako nje kwaphela, kodwa bekuyinto enikelwe namandla wokwenziwa, izakhamuzi zethu nazizakwenzelwa umsebenzi omuhle ngokufaneleko. Kuqakathekile godu nokuthi iimphathiswa kufuze bona zikhambe ngomthetho wokuzirarha, nokuzala izipho neminikelo, njengoba lokho kungathathwa njengokuthengwa nje. 

Sifisa ukubuka nokuthokoza boke abaphathi neemphathimandla abafaka isandla ekukhuthazweni nekuphakanyisweni kweRhelo lokuziPhatha eKorweni yomBuso. Ngithanda ukunikhuthaza ukuthi niqine njalo ngomsebenzi omuhle, begodu ningathomi niyitjhiye esithubeni iselele yokukhuthaza umoya wokusebenza njengabantu abanefundiso embusweni. 

IKomitjhini yabaSebenzi bomBuso ithemba bona incwajana esihlathululi le izakuba yikomba elisizo ekukhuthazeni ukuthembeka nokuzipjatha kuhle emsebenzini, ibe ikhuthazele nokuthi soke sitjhisakalele ukungabubekezeleli ubukhohlakali eSewula Afrika. 

Kokuphela-ke, ngithanda ukukhuthaza boke abasebenzi bombuso ukuthi baqinisekise ukuthi indlela abaziphatha ngayo ikhambisana neenrhuluphelo nekambisolawulo elawula umbuso, nokuthi futhi baziyajeza Irhelo lokuziPhatha kunye nayo iNcwajana esiHlathululi le.

2. 	AMAGAMA WOKUTHOKOZA 

Ihlelo lokutlola iNcwajana Ehlathulula Ngerhelo Lokuziphatha Labasebenzi Bombuso le belingeke likghonakale ngaphandle kokuzinikela nokusekela kwabantu abambalwa neenhlangano eziimbalwa ezifanelwe kubizwa ngamagama:  

	ImiNyango kaRhulumnede omKhulu nemiNyango yaboRhulumende bamaPhrovinsi bawusekele umsebenzi wokutlolwa kweNcwajana esiHlathululi le, ngemva kwalokho baba godu nanemibono yokuthi ingenziwa njani ngcono ukuya phambili iNcwajana le;
	I-Ofisi yoMvikeli womPhakathi nayo ibe nemibono emihle kwamambala ekutlanyweni nekutlolweni kwencwadi le;
	Iinhlangano zabasebenzi namayuniyoni wabasebenzi nawo ahlanganyele nathi emihlanganweni embadlwana nemihlanganweni yeemfundobandulo la aphosele khona imibono neemphakamiso kwezwakala;
	AbaSebenzi be-Ofisi yeKomitjhini yabaSebenzi bomBuso basize emsebenzini wokurhubhulula newokuhlanganisa umtlamo wokugcina walomtlolo;

3. 	INCWAJANA EHLATHULULA NGERHELO LOKUZIPHATHA LABASEBENZI BOMBUSO
  
3.1 	ISINGENISO 

3.1.1 	Umnqopho wencwajana le kuhlathulula ngokuzeleko lokho okuphethwe liRhelo lokuziPhatha. Ukutlolwa kweRhelo langokomthetho lokuziPhatha labaSebenzi bomBuso kufune ukutlolwa ngamagama amafitjhani, anembako nangamagama asemthethweni. Incwajana le inqophe ukwenza Irhelo lokuziphatheli lizwakale kuhle kibo boke abasebenzi bombuso. 
3.1.2 	 Incwajana le akunakambisolawulo etja eza nayo, begodu ilandela isijamiso nendlela yokunombora efanako neseRhelweni lokuziPhatha, ukwenzelela ukuthi kube lula ukulinganisa nokuthomanisa.  Ekusebenziseni kwayo incwajana le, iminyango yombuso kufuze ilinge ukungezelela iimbonelo zayo, eziphathelene nezikhambelana nebhoduluko layo. 
3.1.3 	 Kufanele sitjho sigandelele ukuthi ukutlanywa nokutlolwa kwencwajana le kulihlelo lomsebenzi omkhulu, begodu kufuze sitjho nokuthi kungafuneka ukuthi inande ibuyekezwa, njengeRhelo lokuziPhatha ngokwalo. 

3.2 	UKUTHWASISA 

3.2.1 	Ukuthi kuzokukhuthazeka izinga eliphezulu lokuziphatha ngendlela enefundiso emsebenzini, abasebenzi bombuso kufuze bona bakhuthazwe ukucabanga nokuziphatha ngendlela yefundiso yokuziphatha. Ngalokho-ke incwajana le kufuze isebenze njengesiza yokutlama nokwethula iimfundo ezifitjhazana zokuthwasisa nokubandula boke abasebenzi. Incwajana le iphethe neembonelo ezinengi ezitjengisa uburhiyarhiya besiko nendlela yokuziphatha emsebenzini, ezingasebenza njengesendlalelo sokuthwasisa neseembonelo ekungafundiswa ngazo. 
3.2.2 	Njengomkhabisani weRhelo lokuziPhatha, incwajana le ingasiza ekwenzeni ukuthi umphakathi uhlale ubathemba abasebenzi bombuso ngokuthembeka kwabo nangokungathathi hlangothi kwabo, ngokunikela ubuncani balokho okulindelweko ngendlela yokuziphatha elungileko. 

3.3 	ISIBOPHO SOMQATJHI NABASEBENZI

3.3.1 	Kuliqiniso elivunywa mumuntu woke ukuthi abantu bafunda ngokutjheja nokulimuka. Ngenca yalokhu-ke, kubekwa isibopho esikhethekileko phezu komqatjhi, iimphathimandla (aboNgqongqotjhe naboSomkhandlu) ezingeni lepolitiki, nabaphathi babasebenzi bombuso kiwo woke amazinga, ukuthi bakhe ibhoduluko elifaneleko la kuzakubekwa khona iinrhuluphelo zamagugu, kube kwenziwe neembonelo ezizakuba sibonelo kibo boke abasebenzi.  
3.3.2 	ISekhtjheni 195(1)(a) yomThethosisekelo ifuna bona kuphakanyiswe izinga eliphezulu lomthetho wokuziphatha, belibabalelwe ukuthi lihlale linjalo embusweni ngokuphelela kwawo. Ngokwesivumelwana esihlanganyelweko (i-Public Service Co-Ordinating Bargaining Council Resolution 2 of 1999), boke abasebenzi beKoro yemBusweni banesibopho sokuthambela nokukhambisana neRhelo lokuziPhatha elibekiweko. Njengoba-ke lokhu kusisendlalelo ekwakhelwa phezu kwaso amagadango wokukhambela ngaphambili, nawokulungisa ngitjho nawokukhalima imbala, umqatjhi kufuze enze koke okungakghonakala ukuqinisekisa ukuthi koke okuphethwe mthetho weRhelo lokuziPhatha kwaziwa ngibo boke abasebenzi. 
3.3.3 	Kuqakathekile ukubuyelela godu egameni lokuthi owona mnqopho womthetho weRhelo lokuziPhatha bubuhle bokuphakamisa nokukhuthaza ukuziphatha okusibonelo. Nanyana kunjalo, umsebenzi uzakuthweswa icala lokuziphatha kumbi ngokomThetho otjhiwo ngehla lo, futhi angakhalinywa ngokwamasekhtjheni 18 ukuyokufika ku-27 njengokutjhugululwa kwawo emiThethwenimlingwa wezamaTjhuguluko ka-1997, nakufumaniseka ukuthi uphula umbandela womthetho weRhelo lokuziPhatha. 
 

4. 	 IKOMBA NGEMIBANDELA YERHELO LOKUZIPHATHA 
  
4.1 	UBUDLELWANA NESIBETHAMTHETHO NEBANDLA ELIPHETHEKO

4.1.1 	  Umsebenzi kufuze athembeke eRiphabhligi befuthi ahloniphe umThethosisekelo, akhambe ngemibandela yawo emsebenzini wakhe wawokemalanga.

Igama elithi iRiphabhligi kufuze lithathwe njengegama elitjho ilizwe leSewula Afrika. Kuyifuneko ekulu ukuthi boke abasebenzi bombuso bathembeke elizweni lekhabo. 

UmThethosisekelo ukhuluma ngamaphuzu athileko aphathelene namalungelo nerhuluphelo yazo zoke izakhamuzi. Lombandela weRhelo lokuziPhatha, kokuthoma ufuna ukuthembeka kwabasebenzi bombuso kilelihlelo ledomakhrasi elisebenza njenganje.  Kwesibili, ubukhulu bomThethosisekelo kufuze bamukelwe bebuhlonitjhwe mumuntu woke.  Kwesithathu, omunye nomunye umsebenzi wombuso kufuze abe nelwazi elilingeneko lalokho okuphethwe mThethosisekelo nomnqopho wawo njengendlela yokulawula nokubulunga ihlelo lakhathesi. 

Isibonelo 1:  Abasebenzi bombuso emazingeni ahlukahlukeneko banesandla ukufika ezingeni elithileko ekwenzeni iimphakamiso zemithethokambiso. Nanyana ngisiphi isiphakamiso esenziwako kufuze bona sihlolwe siqalisiswe kuhle ukuqiniseka ukuthi angeze siphambane nomoya namkha/nemibandela ethileko yomThethosisekelo. IKambisolawulo yomthethosisekelo njengokuba nelizwi komphakathi nokwenzelwa kwezinto emkhanyweni emisebenzini eyenzelwa umphakathi kufuze bona nakho kulandelelwe ukufikela la kukghonakala khona ehlelweni lokwakha umthethokambiso.  

Isibonelo 2:  ISekhtjheni 33(2) yomThethosisekelo ithi woke umuntu amalungelo wakhe akhisinyezwe magadango wokuphatha nokulawula unelungelo lokunikelwa iinzathu ezitloliweko.  Lokhu-ke kutjho ukuthi omunye nomunye umsebenzi wembusweni nakazakukghona ukukhamba ngemibandela yomThethosisekelo, kufuze bona enze iqiniso lokuthi iinqunto namagadango athathwa kezokuphatha athathwa ngeenzathu ezizwakalako, kobanyana iinzathwezo zinganikelwa umuntu loyo othintekileko. Lokhu-ke kutjho ukuthi woke amagadango wezokuphatha kufuze bona aphumelele nakalingwako kuhlolwa ukuthi athethwe ngehlelo lokwenzela izinto emkhanyweni na. 
      
4.1.2 	Umsebenzi kufuze abeke irhuluphelo yomphakathi phambili ekurageni kwakhe umsebenzi wakhe

Lombandela utjho ukuthi la kufuze kuthathwe khona iinqunto namkha la kufuze bona umuntu azisebenzisele khona ingqondwakhe ngokubona kwakhe, kufuze bona kucatjangelwe iinrhuluphelo zomphakathi ntanzi. Iinrhuluphelo nekareko yomsebenzi wombuso ngokwakhe namkha ezinye iinrhuluphelo ezihlangothi linye kufuze bona zize ngemva kweenrhuluphelo zomphakathi. 

Isibonelo 1:  I-athizeni esebenza esibhedlela ibotjhelelwe yikontraga yayo yomsebenzi ukuthi isebenze ukusukela ngo-08:00 ukuyokufikela ngo-16:30. Akunakambiso ebekiweko emalungana ne-overtime ebhadalwako. Izulu libethe lawisa isiteyitjhi segezi ekhanyiswa esibhedlela, nje-ke amathiyetha asebenza ngejenereyidi. Nayo ijenereyidi leyo iyahlupha, ngalokho-ke i-athizeni leyo ilayelwa bona iyokulungisa ijenereyidi leyo ngo-16:00. Ebujameni bezinto obunjalo kuzakulindeleka ukuthi i-athizeni leyo iqede umsebenzi wokulungisa ijenereyidi leyo ngaphambi kobana ingatjhayisa, ngitjho nanyana ingasebenza bekudlule isikhathi sayo esibekwe yikontraga yayo yomsebenzi. 
 
Isibonelo 2:  Ubunengi babasebenzi abasebenza e-ofisini yesiphande batjengisa ukuthi bafuna ukuthatha ilifu yabo ngoDisemba. Nange boke njalo bangavunyelwa ukuthatha ilifu ngasikhathi sinye njalo, kuzakutjho ukuthi ngesikhatheso i-ofisi angeke ikghone ukuwusebenzela kuhle umphakathi. Lokho-ke kutjho ukuthi abaphathi nabasebenzi kuzakufuneka ukuthi bakhulumisane bezwane, kube nabarhobhako ekarekweni yabo, kobanyana kuzokuba nabantu abaneleko abazakusala basenza umsebenzi ngendlela ejayelekileko, abanye nabasaye elifini. 


4.1.3 	  Umsebenzi kufuze ayilandele ngokuthembeka imithethokambiso kaRhulumende wakhathesi ekwenzeni kwakhe umsebenzi wakhe wemthethweni njengoba kusitjho zoke lincwadi zomthetho nezinye linqintelo

IVikelamalungelo emThethwenisisekelo, hlangana nokhunye ekuvikelako, ivikela namalungelo wepolitiki wesinye nesinye isakhamuzi, ekubalwa hlangana nawo nelungelo lokukhambisana kunye nelokuba lilungu lesiqhema sepolitiki esithandwa ngiso.  Umphumela wekhetho kukuthi isiqhema sepolitiki esithola amavowudi amanengi kube ngiso esithatha umbuso. Lokhu-ke kutjho ukuthi ikareko ethileko yomsebenzi wembusweni angeze yavela emphumelweni wekhetho. Nokho-ke abasebenzi bombuso kufuneka bamsebenzele ngokuzinikela, nangokuthembeka kunye nangelwazi labo elipheleleko uRhulumende okhethiweko wesikhatheso nabaphumelelisa imithethokambiso yakhe. 

Isibonelo 1:  Umsebenzi wombuso yena ngesingaye ukholwa ukuthi ukuqalelelwa kwamaphilo wabantu ngikho ekufuze kube phambili kinayo yoke imisebenzi eyenzelwa isitjhaba elizweni lekhethu, begodu umsebenzi wembusweni loyo bewusekela nesiqhema sepolitiki esikhambisana naloyo umbono. Nokho-ke uRhulumende obusako yena uvumelana ngokuthi imisebenzi azayitjheja ngaphambi kwayo yoke eminye kuzakuba kukwakhela abantu izindlu, nokucitha ubulelesi. Umsebenzi wembusweni loyo kuzakulindeleka ukuthi alamukele irherho lakaRhulumende lokukhambisa izinto. Nokho-ke lokhu akusikho ukugandelela imibono eyakhako yabasebenzi bembusweni.

Isibonelo 2:  Nakube uRhulumende obusako ucabanga ukuthoma ihlelo elithileko, kufumaniseke ukuthi kuzakuba msebenzi womsebenzi wembusweni othileko ukukhanyisa indlela yokuthi ihlelwelo lingasetjenzwa njani, umsebenzi loyo kuzakufanela ukuthi ayibekele ngeqadi yakhe imibono nemizwa, ngitjho nanyana mhlamunye kungenzeka angavumelani nehlelo uRhulumende afuna ukulithatha, aqale izinto ngamehlo avuleke womabili ngokuqala ubuhle nobumbi beengcenye zehlelwelo, ngaleyindlela alinge ukuthola indlela ehle yehlelwelo ebantwini ekufuze liyokusebenza kibo. 

4.1.4 	  Umsebenzi wombuso kufuze asebenzele ukwazi nokuthambela yoke imilayelo yomthetho neminye imilayo esebenza ekuziphatheni kwakhe nemisebenzini yakhe

Umsebenzi wombuso nakazakukghona ukusebenzela uRhulumende obusako kuhle, akghone nokusebenzela umphakathi kuhle, kufuze bona azi okungaphakathi komsebenzi wakhe, azi nemithethokambiso umsebenzakhe ekufuze bona ukhanjiswe ngayo, ngokunjalo azi nekambiso ekufuze umsebenzakhe ukhanjiswe ngayo. 

Ama-suphavayiza athwele umsebenzi wokuqinisekisa ukuthi abasebenzi bayazi bona imisebenzabo ithini, nokuthi iphetheni.  Abasebenzi nabo ngokunjalo bathwele isibopho esifanako sokwenza umzamo wokuba basebenzi abanelwazi, abakwazi nokusebenza kuhle nangokulandela imithethokambiso ebekiweko, kobanyana kuzokusizakala umphakathi ngokuphelela kwawo. 

Isibonelo 1:  Ngoba singakajayeli iinqintelo zeemali zeKoro yabaSebenzi bomBuso, isiphathimandla esithileko sivumela ukuthengwa kwepahla ethileko ngaphandle kokuthola imvumo efaneleko emNyangweni olawula iimali. Igadango elinjalo lizakutjho ukuthi kusetjenziswe imali ingakavunyelwa ukusetjenziswa, begodu lingabanga ukusetjenziswa kweemali ezinengi kugjinyiswana emakhotho, kulingwa nokulungisa umonakalo owenzekileko. 

Isibonelo 2:  Ngenca yokutlhoga ilwazi, umsebenzi othileko udurhisa umuntu owenza isibawo sokurhola umrholo wepentjheni, amtjele iimfuneko ezingasizo zokuthola umrholo onjalo, nendlela engasiyo ekufuze ayilandele nakenza isibawo esinjalo, namkha amtjele imali engasiyo yomrholo azawuthola umuntu loyo.  Lokho-ke kungaba nomphumela omumbi phezu komuntu obawa ukuthola umrholo wepentjheni loyo. 

4.1.5	Umsebenzi kufuze asebenzisane ngokubambisana neenjamiso zombuso ezisungulwe ngomthetho nangoMthethosisekelo wokukhuthazela ikareko yomphakathi

	Isibonelo 1:  Umsebenzi othileko uphethe isikhundla emnyangweni la kusetjenzwa khona ngeembawo ezivela emphakathini, zokwenzela umbuso imisebenzi ethileko. 	Kuqakathekile ukuthi abasebenzi balimuke ukuthi ngokujoyina kwabo iKoro yabaSebenzi bomBuso, bazibophelele ngokusebenzela umphakathi woke.

	URhulumende obusako uwubeke wakhanya umnqopho wakhe wokuqalelela abantu ababedimeke amathuba phambilini, njengoba kusitjho iHlelo loKwakha nokuVuselela (i-RDP).  Lokhu-ke kufuze bona kwenziwe ngiyo yoke iminyango kaRhulumende, ngemisebenzi eyabelwe yona ngokwahlukahlukana. 
	
	ISewula Afrika ililizwe elisathuthukako, kanti-ke ngenca yabonobangela abahlukahlukeneko, ubunengi babantu bayo abanalwazi ngamalungelo wabo, nangemisebenzi esibopho kibo, nangemisebenzi ekufaneleko nakanjani benzelwe yona, nangekambiso ekufuze bayilandele, nokuthi kufuze bakhulumisane nobani malungana nalokho. Njengoba iKoro yabaSebenzi bomBuso isebenzela boke abantu bayo nje, abasebenzi bayo kumsebenzabo ukwazisa boke abantu bomphakathi abanganalwazi, babatjengise indlela, babaphe nesizo abalitlhogako.  Lokhu-ke kufuze bona kwenziwe kuhle nangomoya omuhle, ngitjho nanyana kungatjho ukuthi umuntu adluliselwe kesinye isijamiso namkha komunye umakho, ngomoya omuhle nokho.

	Njengoba sekutjhiwo, iKoro yabaSebenzi bomBuso isebenzela boke abantu nawo woke umphakathi eSewula Afrika, ngaphandle kokukhetha ukuthi babobani. 	Njengoba iKoro yabaSebenzi bomBuso isebenzela woke umphakathi nje, nawo ohlukaniswe ngeengabagaba zeeqhema, iinhlangano zepolitiki kunye nabantu beenkolelo ngokwahlukahluka njalo njalo, kuyazitjho-ke ukuthi abasebenzi bombuso akukafaneli bona bazihlanganise neendaba ezingabenza babonakale njengabantu abakhetha namkha abenyula ezinye iinqhema kunezinye.

Umsebenzi ongakwaziko lokhu, kodwa owazi okhunye okusaje kumininingwana ekusetjenzelwa phezu kwayo, kungenzeka anikele umphakathi imininingwana engasisemthethweni.  Umbuso ungabe uphathiswe iinhloni kokugcina nange kungenzeka kwenziwe amatjhuguluko athileko ehlelweni ekusetjenzwa ngalwelo, kodwa ekugcineni ligcine lisetjenziswe ngendlela ehlukileko kinalokho ebekulindelwe mphakathi. 


4.3	UBUDLELWANA  HLANGANA NABASEBENZI

4.3.1	Umsebenzi usebenzisana ngokuzwana nabanye abasebenzi ukuphumelelisa ikareko yomphakathi

Kuqakathekile ukuthi boke abasebenzi balimuke ukuthi basebenzela umnqopho munye, okuphumelelisa imisebenzi kaRhulumende obusako, nokuzalisa iimfuneko zomphakathi ngendlela ethembekako nelungileko. Ngalokho-ke abasebenzi kufuze bona benze imizamo ekhethekileko yokusebenza ngokuzwana.  Ngokusizana nangokusekelana, nangokwabelana ngelwazii, nangemibono, ngitjho nangemithombo yamandla yokusebenza imbala (la kufanele khona), abasebenzi bazabe bavulelwe ithuba lokusebenza ngcono, ngendlela ezakubuyisela uRhulumende nomphakathi. 

Isibonelo 1:  Kuqakathekile ukuwazi woke umnqopho wekoro yombuso, nokulimuka ukuthi ngitjho nencazana ingcenye eyenziwa lapho, nayenziwe ngefanelo, iphumelelisa umnqopho ngokuphelela kwawo.  Ngenca yalokhu-ke umsebenzi kufuze bona ayamukele imibono neemphakamiso zabangani bakhe asebenza nabo, nezamanye amaphiko wembusweni. Phela embusweni akunandawo yomona neyokunina abanye ukuthi bagadunge la ngisebenzela  khona.  

Isibonelo 2:  Umsebenzi nakalimuka ukuthi isidingo esithileko somphakathi sizangazaliseka kuhle i-ofisi yakhe nayisebenzisana ngokuzwana nenye, umsebenzi loyo kufuze akazihluphe afunisise ngendlela yokusebenzisana leyo, ngitjho nanyana iimphathiswa kamanye ama-ofisi lawo kungenzeka ukuthi zingadoselani nokusebenzisana okunjalo ekuthomeni. 

Isibonelo 3:  Isiphathimandla esithileko sifikelwa ngomunye umnyango uzosibawa ukuyokuba yingcenye yebandla eliyokukhetha abasebenzi abafuna umsebenzi.  Umsebenzi loyo akasize njengoba bambawile, la kukghonakala khona.  Nokho-ke nakasiza njalo umsebenzi loyo kufuze bona acabangele wakhe umsebenzi, womnyango wakhe, abawa imvumo komphetheko.  

4.3.2	Umsebenzi wenza yoke imilayelo elungileko ayinikelwa babantu ababekwe ngokusemthethweni ukumupha imilayelo, kwaphela nakube imilayelo leyo ayiphambani nemibandela yomThethosisekelo namkha/neminye imithetho. 

Kuqakathekile ukuthi abasebenzi bayilandele yoke imilayelo elungileko abanikelewa yona, ukwenzelela ukuqinisekisa ukuthi umphakathi wenzelwa imisebenzi ngendlela ehleleke kuhle. Iinhlangano ezikulu ezinjengeminyango yembusweni zingasebenza kuhle kwaphela nakuneendlela ezihle nezilungileko zokuphatha nokulawula ezihlonitjhwa ngabaphethweko. Imilayelo yoke nayingenziwa ngesikhathi nangendlela efaneleko, ihlangano ngokuphelela kwayo izakusebenza kuhle. 

Isibonelo 1:  Umsebenzi ulayelwa sikhulu sezokuphatha namkha isikhulu sakasopolitiki ukuthi enze okuthileko okungakavunyelwa milayelo ebusa iKoro yabaSebenzi bomBuso.  Umsebenzi loyo kufuze azi imithetho, ngendlela yokuthi nakwenzeka into enjalo azokwazi ukutjela isikhulweso ukuthi sifuna ukumenzisa into ephambene nomthetho.  Nakufumaniseka ukuthi isikhulweso siyaphikelela ngokufuna ukumenzisa okuphambene nomthetho njalo, umsebenzi kuzakufuneka ukuthi abawe ukuthi isikhulweso sikutlole phasi lokho esifuna akwenze, bese uyaveza ukuthi umsebenzi loyo akavumelani nokwenziswa lokho okuthiwa akakwenze, bese kuyokubikelwa isikhulu esifaneleko.  

Isibonelo 2:  Umsebenzi nakalayelwa sikhulu sakhe ukuthi a-ode ipahla ethileko la kungakhange kulandelwe khona ikambiso elungileko yokuthendara, umsebenzi loyo angabawa ukuthi indaba leyo idluliselwe kusoma-akhawundi, kobanyana kube nguye othatha isiqunto ngalokho. 

4.3.3 	  Umsebenzi kufuze ale ukwenyula iinhlobo zakhe nabangani eendabeni eziphathelene nomsebenzi, begodu angathomi asebenzise isikhundla sakhe somsebenzi ukwenzisa omunye umsebenzi okuthileko okungakalungi, godu angavumeli ukwenziswa okuthileko okumdlalisa ngamandla wesikhundla sakhe.

    IKoro yabaSebenzi bomBuso kufuze iqatjhe abasebenzi, ibakhuphule eenkhundleni zomsebenzi, ibe nendlela ebathokoza ngayo, nakube bawenza kuhle umsebenzabo, ngaphandle kokukhetha ukuthi bangebaziphi iinhlangano zepolitiki, nangaphandle kokukhetha ukuthi bahlobani nabobani, nangaphandle kokuqala ukuthi bazana nabobani emphakathini. Lokhu okulandelako zizinto ezingakavumakali ukwenziwa: 

(a)	Ukwenyulana - lokhu-ke kutjho kuqatjhwa abasebenzi abathileko abakhethiweko ngabomu, baphakanyiselwe eenkhundleni eziphezulu, badluliselwe eenkhundleni ezingcono, namkha baphathwe ngezandla ezibutofotofo ngoba babakhozi namkha bathokozelwa okuthileko abakhe bakwenza, njll.  

(b)	Ukudlisa Ngobuhlobo - lokhu-ke kutjho ukuthi umsebenzi uqatjhwa, aphakanyiselwe esikhundleni esiphezulu, adluliselwe esikhundleni esingcono namkha enzelwe obunye ubuhle bomsebenzi ngoba anesihlobo esisesikhundleni samandla namkha ngoba azana nomuntu osesikhundleni samandla esikwazi ukufaka umoya wokuthi kwenzelwe umsebenzi loyo ubuhle nobungcono ayedwa. 

Isibonelo 1:  Abasebenzi ababili (u-A no-B) bangena emsebenzini embusweni. Banikelwa iinkhundla ezifanako, babangani, futhi basebenza ofisi yinye. Umsebenzi B uyaphakanyiswa uba Mphathi kaNomzana A.  Ngenca yalokho-ke selakghona ukunikela uNomzana A imisebenzi ekhethekileko, kobanyana azokuba nethuba eligcono lokwenza imisebenzi emihle kunabanye abasebenzi, ngendlela yokuthi azokuvulekelwa mathuba wokubonakala asebenza ngcono kunabanye abasebenzi nasele kulhlolwa kulinganiswa ukuthi basebenza njani. Isibonelo 2:  Umsebenzi uba sehlelweni lokukhetha umuntu ekufuze aqatjhelwe umsebenzi othileko embusweni.  Umsebenzi loyo wenyula umuntu othileko ngoba umuntu loyo amkhozakhe, namkha ngoba bamalungu wesiqhema sepolitiki sinye, namkha ngoba mhlamunye bamhlobo munye.  Lokhu-ke kukudlisana ngobuhlobo, okuphambana nomnqopho womThethosisekelo neenrhuluphelo zomBuso. 

Isibonelon 3:  Zinengi iindlela umsebenzi osesikhundleni esiphezulu angasebenzisa ngazo isikhundla sakhe butjhwileni. Isibonelo: Abasebenzi abalawula iinkoloyi ezingena ephaga yeenkoloyi balayelwe kuhle ukuthi indawo yokuphaga leyo ngeyeenkhulu kwaphela, neemvakatjhi ezize ngomsebenzi.  Nokho-ke isikhulu se-ofisi siyeqisa amehlo imilayo leyo, sinande sivumela umkaso ukuthi aphage ephaga yeenkhulu neemvakatjhi leyo.  Isenzo esinjengaleso senza abasebenzi bangasayihloniphi imithetho, bangasazihloniphi neenkhulu zabo, kanti ngaphezu kwakho koke, isenzo esinjalo siliya ukusebenza kuhle kwehlangano. 

4.3.4 	Umssebenzi kufuze akhambe ngeendlela ezifaneleko ukuzwakalisa iinlilo zakhe namkha ukudlulisa ikulumo anayo 

        Nanyana kuvumakala nje ukuthi iinghonghoyilo, iinlilo nemibango kunande kuba khona emsebenzini embusweni, kodwa kusizakala woke umuntu - umsebenzi ofake isinghonghoyilo, nomqatjhi - kunye nomphakathi woke isinghonghoyilweso nasirarululwa msinyana hlangana nalabo abathintekako kiso. Kungakho-ke kunekambiso ethileko ebekelwe ukulandelwa ngibo boke abasebenzi  ukurarulula iinlilo, iinghonghoyilo kunye nemibango. Kuqakathekile-ke nokho ukukhumbula lokhu okulandelako nakuneenghonghoyilo, iinlilo, nemibango:  

(a)	Isinghonghoyilo namkha umbango ungararululeka kuhle kwaphela nakube iinqhema ezibangako zihlala phasi kukhulunyiswanwe ngomoya wokuzwana/wokubuyisana. 

(b)	Nakube kunesinghonghoyilo, kunombango, umsebenzi angalandela leziindlela: 

(i)	Ikambiso yokufaka isinghonghyilo/isililo (qala usekhtjheni 35 womThetho wezabaSebenzi bomBuso ka-1994, uwufunde nemiThetho ephathelene neenghonghoyilo/neenlilo zeemphathiswa ku-Public Service, Regulation No. 6575, yangomhlaka yangnomhlaka 1 kuJulayi 1999), omunye nomunye umsebenzi angezwakalisa ngayo isililo/isinghonghoyilo sakhe kusuphavayiza yakhe, yena-ke ekufuze bona asidlulisele phambili, nakufumaniseka ukuthi usaphavayiza akakghoni ukusilungisa isinghonghoyilweso namkha ukuwulamula umbango loyo.  

Isibonelo 1:  USuphavayiza ukhuluma kumbi indlela umsebenzi othileko asebenza ngayo, nakuhlolwa ukuthi abasebenzi basebenza njani, ngaphandle kokunikela umsebenzi loyo ithuba elifaneleko lokuthi naye azikhulumele. Lokho-ke kuphambana nemithetho elawula abasebenzi nobudlelwana babo nabaqatjhi. ISuphavayiza yabasebenzi bombuso kufuze bona ilimuke ukuthi iKoro yabaSebenzi bomBuso kufuze bona ibe sibonelo esihle malungana nalokho okutjhiwo mithetho yelizwe, kunye nendlela nomoya ekutjho ngawo, abe enze neqiniso lokuthi uhlala enza okulungileko. 


(ii)	Ikambiso yebhodi yezokubuyisana (ngokwe-ayithemu 15(1) yeTjhejuli 7 yomThetho ka-1995 wezobuDlelwana bezabaSebenzi), umsebenzi angabikela ngayo isikhulu somnyango umbango wokungaphathwa kuhle komunye namkha kwabanye abasebenzi. Isikhulu somnyango sona-ke kufuze bona sivule ibhodi yezokubuyisana bese sidlulisela indaba le kiyo, nakufumaniseka ukuthi siyabhalelwa kukuyirarulula sona ngokwaso. 

Isibonelo 2:  Isithunywa esinesililo ngokuthi kubonakala ungathi siqotjhwa emsebenzini ngendlela engakalungi singabikela isikhulu esingamele umnyango loyo, sona-ke ekufuze bona siqale umraro loyo sibone ukuthi urarululeka kuhle. Nakufumaniseka ukuthi isikhulu somnyango siyabhalelwa kurarulula umraro loyo kungakapheli ama-20 wamalanga, isithunywa esinesililweso singabawa isikhulu somnyango bona sivule ibhodi yokubuyisana kungakapheli i-10 lamalanga, yona-ke ezakulinga ukurarulula umraro loyo. Nakufumaniseka ukuthi ibhodi yokubuyisana nayo iyabhalelwa kukuwurarulula umraro loyo, isithunywa esinesililo sesingadlulela eKhotho yezabaSebenzi, siyokufuna khona isizo. 
	
(iii)	Nakube isililo somsebenzi siphathelene nokungakhanjiswa kuhle kwezinto nokwenziwa kwezinto ngendlela yokuzindlekela zisenziwa umBuso njengomqatjhi, isililweso/umbango ungadluliselwa kuMvikeli woMphakathi.

Isibonelo 3:  Isithunywa esibona kwenziwa izinto ezingakalungi emsebenzini waso singabikela isuphavayiza yaso namkha sibikele isikhulu somnyango waso ngalokho.  Nakube isithunyweso asaneliseki ngependulo yesuphavayiza namkha yesikhulu somnyango, sesingadlulela kuMvikeli woMphakathi. Laphokhunye-ke isithunywa singenyula ukuvele sitjhinge kuMvikeli woMphakathi zibekwa nje ngesililo saso.  
  
4.3.5 	Umsebenzi kufuze azibophelele ngokusebenzela ukuthuthukisela abasebenzi bakhe ezingeni eliphezulu, abakhuthaze abasebenzise kuhle, akhuthazele nobudlelwana obuhle bemsebenzini nebokuzwana. 

Ukuphumelelisa umnqopho wekoro yembusweni ngokuphelela kwayo, okusebenzela umphakathi kuhle khulu, woke amasuphavayiza/abaphathi ekorweni yembusweni bathwele isibopho sokubona ukuthi boke abasebenzi abasebenza ngaphasi kwabo banelwazi nekghono lokwenza umsebenzabo ngefanelo, babone nokuthi bayakhuthazeka ukuthi benze umsebenzabo loyo, befuthi bayafisa bebayakghona nokukhuthaza ubudlelwana obuhle. Ekusebenzeleni ukuphumelelisa lokhu, isuphavayiza kufuze bona ikhumbule lokhu okulandelako:  

(a)	Ukuthuthukiswa kwabasebenzi kutjho ukuthi umsebenzi osesikhundleni sobusuphavayiza namkha sokuphatha kufuze bona: 

       (i)		azi kuhle ukuthi ukuthuthukisa abasebenzi kutjho ini nani;
       (ii)  	ahlale aqala ahlole iindingo zokuthuthukiswa kwabasebenzi;
      (iii)  	abeke ihlelo ekuzakuthuthukiswa ngalo abasebenzi;
      (iv)  	abone ukuthi ihlelo lokuthuthukisa abasebenzi liyalandelwa;
      (v)  	ahlale elusile ukuthi ihlelo lokuthuthukisa abasebenzelo liraga njengoba kufanele na; 
       
Isibonelo 1:  ISuphavayiza, ngokubonisana nomsebenzi osandukuqatjhwa, kufuze bona athole iindingo zokuthwasiswa (zokufundiselwa umsebenzi) kiloyomsebenzi. Iindingo zokufundiselwa umsebenzi ezitholakeleko kufuze bona zithathwe zifakwe ehlelweni lokuthwasisa umsebenzi loyo, elikhambisana nomsebenzi wakhe umsebenzi loyo, namkha eliphethwe yincwajana yekambiso yomsebenzi wakhe. (b)	Ukukhuthazwa kuhle kwabasebenzi kutjho ukuthi umsebenzi osesikhundleni sobusuphavayiza namkha sokuphatha kufuze bona: 

   (i)	azi ukuthi ukukhuthaza abasebenzi kutjho ukuthini;
   (ii)	ahlole alinganise ukuthi abasebenzi bakhuthazeke kangangani emoyeni ngomsebenzi wabo;
(iii)	avule iindlela zokukhuphula izinga lokukhuthazeka kwabasebenzi, nakube kuyafuneka;
  (iv)	ahlale elusile ukuthi abasebenzi bakhuthazeke kangangani;
 
(c)	Ukusetjenziswa kuhle kwabasebenzi kutjho ukuthi umsebenzi osesikhundleni sobusuphavayiza namkha sokuphatha kufuze bona: 

      (i)  	azi bona kutjho ukuthini ukusetjenziswa kuhle kwabasebenzi;
      (ii)  	alinganise ukuthi basetjenziswa kuhle kangangani abasebenzi;
      (iii)  	abeke iindlela ezivula amathuba wokusetjenziswa kuhle kwabasebenzi; begodu
(iv)	ahlale abeke ilihlo eliqala ukuthi basetjenziswa kuhle na abasebenzi.

Isibonelo 2:  Amasuphavayiza namkha abaphathi kufuze bahlale babeke ilihlo baqale ukuthi ungangani umsebenzi owenziwa basebenzi, nokuthi bawenza kilipha izinga, ukwenzela ukwenza iqiniso lokuthi boke abasebenzi basetjenziswa kuhle ngokupheleleko.  Lokhu-ke kuzakukhandela ukuthi kungabi nabasebenzi abanomsebenzi omnengi khulu, ukube abanye banomsebenzi omncani khulu.  Abasebenzi nabo kufuze bona bazijayeze ukwenza nemisebenzi imisebenzi engaphezu kwesikhundla somsebenzi wabo, kobanyana bazokwazi ukukhula bathuthuke ngelwazi lomsebenzi, kobanyana bazokutholakala bawulungele umsebenzi nakufika isikhathi sokuthi kufuneke bona benze umsebenzi osezingeni elingaphezu kewabo. 
    
(d)	Ukukhuthazwa kobudlelwana obuhle bemsebenzini nebokuzwana hlangana nabasebenzi kutjho ukuthi umsebenzi osesikhundleni sobusuphavayiza namkha sokuphatha kufuze bona: 

(i)	azi kuhle ukuthi kutjho ukuthini ukuba nobudlelwana obuhle bemsebenzini nebokuzwana hlangana nabasebenzi;
  (ii) 	alinganise ukuthi ubudlelwana bemsebenzini buhle kangangani hlangana nabasebenzi, nokuthi abasebenzi ngokwabo bezwana kangangani;
(iii)	avule iindlela zokwenza ubudlelwana bemsebenzini bube ngcono, nebokuzwana hlangana nabasebenzi bube ngcono, nakube kuyafuneka; begodu
(iv)	ahlale abeke ilihlo ukuthi ubudlelwana bemsebenzini nokuzwana hlangana nabasebenzi kuhlale kukuhle. 

Isibonelo 3:  Amasuphavayiza namkha abaphathi kufuze babeke ilihlo batjheje ukuthi kuhlala kunomoya wokuzwana newokusebenzisana ndawonye hlangana kwabasebenzi, balamule msinyana nakufumaniseka ukuthi kunomoya wokungezwani newokusebenzisana ngokuphikisana hlangana nabo abasebenzi. 

4.3.6	Umsebenzi kufuze asebenze kuhle nangendlela efundisiweko nelungileko nabanye abasebenzi, ngaphandle kokukhetha ubuzwe, ubulili, ukuthi umuntu umhlobobani, ugowamuphi umphakathi, umbalabani, wenyula ukuphilisana nesingani sabulilibani, mdala kangangani, ngowayiphi ikolo, ngowayiphi ipolitiki, ngowayiphi ikolelo, nokuthi ngowesiko namkha ilimi liphi.
       
UmThethosisekelo, umthetho wezabasebenzi newokuqatjhwa kwabo kunye nomThetho ongakaTlolwa, unikela abasebenzi bombuso ilungelo lokuphathwa kuhle nangokulingana. Nakufumaniseka ukuthi ilungelwelo kunendlela elithikaziseka ngayo, abasebenzi bangasebenzisa ihlelo lokulamula imibango elisemThethweni ka-1994 wezabaSebenzi bomBuso, nemiBandela Yokusebenzisana labaSebenzi  bomBuso (i-Public Service Regulations) kunye nomThetho ka-1995 wezobuDlelwana bemiSebenzini, namkha baye eKhotho yezomThethosisekelo, namkha baye eKhotho eKulu namkha baye kuMvikeli woMphakathi bayokufuna khona isizo, kuye ngobujamo bezinto ukuthi bunjani. Ngalokho-ke kuqakathekile ukuthi amasuphavayiza namkha abaphathi ekorweni yabasebenzi  bombuso bazi ukuthi kutjho ukuthini ukuphatheka kuhle nangendlela elungileko. 

(a)	Ukusebenza kuhle nangendlela elungileko nabanye abasebenzi kutjho ukuthi umsebenzi kufuze bona: 

           (i)	ahlale awahlonipha amalungelo akhona (ngokomThetho ongakaTlolwa, nangokoMthethosisekelo, nangokomThetho wezabaSebenzi, nangeminye imithetho efaneleko) wabanye abasebenzi; 
          (ii)	ahlale anikela abanye abasebenzi ithuba lokuzikhulumela baveze ihlangothi lendaba ekukhulunywa ngayo;
          (iii)	ahlale avumela abanye abasebenzi ukuthi babe nabajameli nakube babawa njalo; begodu 
          (iv)	ahlale azimisele ukukhulumisana/ukubonisana ngengqondo evulekileko. 

Isibonelo 1:  Lokhuya umsebenzi nakabekwe mhlamunye icala lokungaziphathi kuhle, kufuze bona icala lakhe likhanjiswe ngekambiso efaneleko begodu likhanjiswe kuhle ngendlela elungileko. 

Ukulunga kwekambiso kutjho ukuthi kufuze kulandelwe ikambiso ethileko yokukhalima, la umsebenzi kufuze khona bona: 

	aziswe kusese nesikhathi ngecala avulelwe lona;
	anikelwe ithuba lokuzikhulumela ecaleni;
	abe nelungelo lokujanyelwa;
	akghone ukuthola loke ilwazi ekufuze alithole;
	abe nelungelo lokuhloma abofakazi imibuzo; godu 
	abe nanelungelo lokudlulisela icala lakhe phambili. 

Ukulunga okupheleleko kutjho ukuthi woke amaphuzu afaneleko kufuze bona aqalwe aqalisiswe ngelihlo elivulekileko nelingathathi hlangothi, ngaphambi kobana kuthathwe isiqunto. 

(b)	Ukusebenzisana ngendlela efundisekileko nabanye abasebenzi, kutjho ukuthi umsebenzi kufuze bona: 

        	(i) 	abe nelwazi elaneleko ngesihloko esithileko;
 	(ii)	akghone ukuyisikimela msinyana imilayo anikelwa yona namkha iimbawo ezimbawa okuthileko;
   	(iii)	asebenzise ingqondwakhe ngokupheleleko endabeni ekuqalwene nayo;
   	(iv)	abe nelitho alenzako esiqhemeni somsebenzi esisebenzisanako, kobanyana kuzokwenziwa umsebenzi/ kuzokurarululwa imiraro;
   	(v)	ahloniphe amalungelo wabanye abasebenzi; begodu 
 	(vi)	acabangele neenrhuluphelo zabanye abathintekako lapho. 
 
 (c)	Ukusebenzisana ngendlela efaneleko nabanye abasebenzi, kutjho ukuthi umsebenzi kufuze: 

       (i)	angabandlululi abanye abasebenzi ngokungakafaneli nanyana ngayiphi indlela;
      (ii)	aphathe boke abasebenzi njengabantu abalinganako ngeenkhathi zoke;
     (iii)	akghone ukuqala izinto ngelihlo eliqala mahlangothi woke, litjheje koke ngaphandle kokutjhigamela ncanye ekuthatheni kwakhe iinqunto ezithinta abanye.

4.4 	UKWENZIWA KWEMISEBENZI
     
4.4.1 	Umsebenzi usebenzela ukuphumelelisa iminqopho yendawo ayisebenzelako ngendlela engadli imali, nangendlela eyanelisa ikarekelo yomphakathi. 

Emsebenzini wabo wawokemalanga, abasebenzi kufuze bahlale bazibuza ukuthi lokho abakwenzako kuyaphumelela na ukuzalisa umnqopho wekoro abayisebenzelako.  Lokhu-ke kufuna ukuthi boke abasebenzi babe nelwazi elipheleleko lokuthi uyini umnqopho wekoro abayisebenzelako namkha wehlangano yabo yoke, ngaphezu kwalokho, kufuze bayazi kuhle nemisebenzabo umsebenzi ngamunye ngamunye, imisebenzi abayenza la basebenzela khona.

Abasebenzi, ngokunjalo namasuphavayiza namkha abaphathi kufuze bona bahlale belusile, baqale ukuthi kungabi namsebenzi obuyelelwako, ukube eqinisweni kufuze wenzise ngesinye isijamiso. 

Isibonelo 1:  Umsebenzi othileko udlala imidlalo ekhomphiyutheni ngekhomphiyutha ye-ofisini, ngesikhathi somsebenzi. Lokhu-ke kukukwenzela phasi umoya wokusebenza ngokuzimisela nangokuzibophelela, begodu kukukweba isikhathi somsebenzi, ngalokho-ke kukukweba nemali yomsebenzi. Isibonelo 2:  Umphathi olawula ihlelo lesabelo seemali kufuze bona atjheje ayelele ekusebenziseni kwakhe iimali zomphakathi ezibekwe ezandleni zakhe ekuphumeleliseni umnqopho wehlelwelo. 4.4.2	Umsebenzi unomkhumbulo omuhle owakhako, uwenza kuhle umsebenzakhe, ufuna Iindlela ezingakavami zokurarulula imiraro, abe aphakamise nendlela yokusebenza kuhle kuphunyeleliswe umsebenzi ngendlela yomthetho.

Abasebenzi kufuze bona bazinikele ngokupheleleko ekwenzeni umsebenzabo. Kufuze bona iinqgondo zabo bazibeke emsebenzini abawenzako qho nabasemsebenzini, balinge nokwenza umsebenzabo msinyana nangcono, kobanyana bazokuthola imiphumela engcono yokwenzela abantu umsebenzi kuhle. Minengi imiraro ekuhlangatjezwanwa nayo emsebenzini ngesikhathi somsebenzi. Abasebenzi kufuze bona balwele ukuthola iindlela zokurarulula imiraro leyo msinyana nangendlela engehle kinazo zoke, ukudlula lapho balinge nokufuna iindlela ezihle zokukhandela ukuthi imiraro enjalo ingaphindi yenzeke.   

Isibonelo 1:  Umsebenzi nakasebenza ephikweni elikhupha iintifikedi nakalimuka ukuthi umphakathi awukaneliseki ngekambiso esetjenziswako ukukhupha iintifikedezo, befuthi side khulu nesikhathi esithathwako ukuthi zilunge iintifikedi, kufuze bona aqale ukuthi kghani angeke athola ezinye na iindlela ezingawukhambisa msinyana umsebenzi lo, bese utjela usuphavayiza wakhe ngombonwakhe loyo.  

Isibonelo  2:   Umsebenzi osebenza e-ofisini esebenza ngomphakathi nakalimuka ukuthi abantu bayatlhaga ukuthola indawo yokuphaga, namkha bajama idresi isikhathi eside, kufuze azihluphe afune indlela ekungararululwa ngayo umraro lo. 4.4.3	Umsebenzi uwenza ngesikhathi esibekiweko umsebenzi wakhe

Abasebenzi abalimuke ukuthi umsebenzabo abanikelwe wona ngokusemthethweni uqakatheke khulu, balimuke nokuthi ngenca yalokhu-ke umsebenzi abanikelwe wona kufuze bona bawenze ngeengqondo zabo ezipheleleko, baziphe nesikhathi esaneleko sokuwenza, bawenze ngamandla apheleleko. Abasebenzi kufuze bona benze umzamo wokuthi umsebenzabo bawuqeda ngesikhathi ababekelwe sona. 
Ukudlula lapho, abasebenzi kufuze bakhuthalele nokuzikhuthaza, umsebenzabo bawenze ngokuthembeka ngokulandela imithetho nemibandela ebekiweko, ngaphandle kokukhunjuzwa mumuntu. 

	Isibonelo 1:  Umsebenzi uladelwa emsebenzini ngenca yokuthi ngayizolo ebusuku uhlezi ephathini kwabe kwaba sebusuku, anjalo nje akakghoni ukwenza umsebenzi wakhe kuhle ngoba udiniwe. Umsebenzi onjalo unecala lokungabi nokuziphendulela, nelokudlala ngemali yomphakathi. 

Isibonelo 2:  Umsebenzi nakazakukghona ukuqeda umsebenzi orhabekileko anikelwe wona, kufuze asebenze ngendlela yokuthi akaphundwa lilanga abekelwe lonelo ukuthi aqede umsebenzi. 4.4.4	Umsebenzi wenza umsebenzi wakhe ngendlela efundisekileko nelungileko. 

Abasebenzi kufuze bona bahlale bazibuza ukuthi umsebenzi abawenzako uyabajabulisa na, bazibuze nokuthi nangathana bebababantu ababenzela umsebenzi loyo ngendlela bawenza ngawo bona bebazawuthokozela na. Abasebenzi godu kufuze bona bahlale bazibuza ukuthi abanye abantu [aba(li)ngani babo bemsebenzini,  amasuphavayiza kunye nomphakathi ] babaphatha ngehlonipho yobuntu babo na, bazibuze nokuthi baveza ilwazi, nethabo ekusebenzisaneni kwabo nabo na, bazibuze godu nokuthi mbala balisizo kibo na.  Ukuthi abasebenzi bakghona kangangani ukwenzela isitjhaba umsebenzi ngendlela ehle nefundisekileko, kuya ngokuthi bona ngokwabo abasebenzabo banelwazi elingangani lomsebenzi abawenzako; lokho-ke ngokwakho kusaqinisela khona ukuqakatheka kwesibopho sabaqatjhi nabasebenzi ngokwabo sokuqalelela ukufundiswa kwabasebenzi umsebenzi (ukuthwasiswa). 

	Isibonelo  1:  Kesinye isikhathi umsebenzi osebenza ekhawuthareni kufuneka asize umuntu obonakala ungathi akazwisisi ukuthi kubayini izinto ezithileko kufuze zenziwe ngendlela ethileko. Umsebenzi osizako akukafaneli ukuthi aphakamise umoya ebujamweni obunjalo, kodwa kufuze bona ahlathululele umuntu ngesineke iinzathu ezenza bona izinto zenziwe ngendlela zenziwa ngayo. Nakufumaniseka ukuthi nalapho umuntu loyo solo akazwisisi, umsebenzi anganonisa umuntu loyo ukuthi asitlole phasi isililo sakhe, abe amnikele ne-adresi la kufuze sithunyelwe khona. 

Isibonelo 2:  Nakube umsebenzi usebenza ukuphendula imibuzo yomphakathi etloliweko, kufuze bona enze iqiniso lokuthi yoke imibuzo iphendulwa msinyana, enze neqiniso lokuthi iimpendulwezo zingezilungileko, befuthi zitloleke ngelimi elihle, lokuzithoba. La kufumaniseka ukuthi akukghonakali ukuphendula khonokho, ubuncani umsebenzi angabenza kutlola incwadi khonokho atjho ukuthi uyitholile incwadi ebuzako, kodwa ipendulo isalungiswa. 

Isibonelo 3:  Umsebenzi osandukungena emsebenzini ubekwa ekhawuthareni la kusizelwa khona abantu ngaphandle kobana kube nomuntu omqalileko ukuthi usebenza njani, begodu ukube akakabuwuthwasela nomsebenzi loyo. Nanyana abanye bangathi vele umsebenzi loyo kufuzile afunde umsebenzi asebenza nje, kodwa kufuze kukhunjulwe ukuthi igama lomqatjhi lingonakala kangangani nange kungenzeka umsebenzi loyo aphosise enze okungakalungi, kucatjangwe nokuthi ungangani umonakalo ongenzeka ngenca yokubambezeleka komphakathi ukusizeka. 

4.4.5	Umsebenzi akazifaki emahlelweni namkha enze izinto ezizakuliyana nomsebenzi wakhe.    

Ukwakha ukuthembeka ekorweni yabasebenzi bombuso nokwenza ukuthi kuhlale kukhona ukuthembekokho, boke abasebenzi bombuso balindeleke ukuthi basebenze ngokuthembeka nangokuzinikela.  Lokhu-ke kufuna abasebenzi, nanyana basemsebenzini nanyana abakho emsebenzini, bangazihlanganisi nezinto: 

(a) 	ezingathathwa njengokukhwabanisa namkha ubusela;
(b) 	ezingacabhelana nomsebenzi wabo;
(c) 	ezingafaka umoya othileko emsebenzini abawenzako;
(d)	ezingafaka umoya othileko ongabenza babhalelwe kuqala izinto 	ngokulingana ekuthatheni kwabo iinqunto;
(e) 	ezingaphathisa umBuso iinhloni njengoba umuqatjhi nje;  namkha 
(f)  	ezingenza babonwe njengabantu abatjhigamele ncanye nokuqala bathande, bakhethe, benyule abanye kunabanye ngokungafaneli. 

Indlela abasebenzi abaziphatha ngayo emsebenzini nangaphandle komsebenzi kufuze ukuthi ibe ngendlela yokuthi uRhulumende obusako namalungu womphakathi bazabathemba ukuthi bawenza ngokuthembeka umsebenzabo, ngokuqalelela kwaphela umnqopho wokusebenzela umphakathi kuhle kwamambala. 

Isibonelo 1:  Umsebenzi osebenza ngokuhlola umthelo, nanyana usemsebenzini nanyana ngesikhathi sakhe, akakafaneli ukuvumela umphakathi umthenge kobana awusize ngokuthi ungakubalekela njani ukubhadala umthelo.

Isibonelo 2:  Umsebenzi akakafaneli ukuba lilungu lebhodi namkha lehlangano esebenzisana nomnyango wakhe.

4.4.6	Umsebenzi kufuze azitsomule ehlelweni elisemthethweni lokuthatha iinqunto elingahle libangele ukuthi athole inzuzo ngokungakafaneli, begodu lokhu-ke kufuze bona umsebenzi akumemezele ngokwefanelo. 

Abasebenzi nababona ukuthi angeke bakghone ukuhlala baqale izinto zoke ngelihle elilinganako nelingakhethiko ekuthathweni kweenqunto, namkha nababona ukuthi abanye abantu bangahle babasole ngokuthi angeze bakghone ukuhlala baqale izinto ngelihlo elilinganako nelingakhethiko ngenca yokuthi baseenjamisweni ezithileko zangaphandle, kufuze bona bazitsomule khonokho emahlelweni anjalo kobanyana kuzokuvikeleka isithunzi negama elihle lokuthembeka kweKoro yabaSebenzi bomBuso. 

Isibonelo 1:  Umsebenzii nakasebandleni elikhetha umsebenzi ekufuze avale isikhundla somsebenzi, bese uthola ukuthi omunye wekhabo naye wenze isibawo somsebenzi loyo wabe wayokufika ehlandleni lokugcina lokuhlolwa kokugcina kwabangalungela umsebenzi loyo, umsebenzi loyo kufuze bona azitsomule ebandla elihlola abasebenzabo, ngoba angeke athathwa ukuthi uzakukghona ukuhlala aqala izinto ngelihlo elilinganako nelingakhethiko ehlelweni elinjalo.  Begodu umsebenzi loyo kufuze atlole incwadi akuveze lokho. 

Isibonelo 2:  Nakube umsebenzi usehlelweni lomBuso lokuthenga inarha, ukube kodwa enye yenarha leyo ingeyesihlobo sakhe, umsebenzi loyo kufuze abikele abaphathi bakhe ngalokho, bese uyazitsomula emsebenzi wokuthenga inarha. 

4.4.7	Umsebenzi uyasivuma isibopho sokulisebenzisa ithuba lokuhlale afundiselwa umsebenzi ukuya phambili nelokuzithuthukisa ukuya phambili ngaso soke isikhathi emsebenzini wakhe. 

Kumsebenzi osibopho ebaphathini nakumasuphavayiza ukubona ukuthi abasebenzi babo bahlale bathwasiselwa umsebenzi, ukwenzelela ukuthi bazokwazi ukuzenzela umsebenzabo babodwa ngaphandle kokulandelelwa, futhi bazokuhloma nangelwazi lokubathuthukisa ngomuso.  Nokho-ke kumsebenzi osemahlombe womunye nomunye umsebenzi ukuthatha amagadango wokuqinisekisa ukuthi:

(a)	unelwazi elipheleleko lokuthi yini elindeleke kuye njengomsebenzi wembusweni;
(b)	unelwazi elipheleleko lokuthi wenziwa njani umsebenzi wakhe; begodu 
(c)	wandisa ilwazi lakhe nekghono lakhe lomsebenzi, kobanyana ngomuso azokwazi ukusetjenziswa neenkhundleni eziphezulu. 

Isibonelo 1: Nakube umsebenzi osandukuqatjhwa akanaqiniso lokuthi wenziwa njani umsebenzi ekufuze awenze, kufuze bona ayokuqala imilayo elawula umsebenzi loyo, abawe isizo neba(li)nganini bakhe namkha kusuphavayiza wakhe, namkha ababuze bobabili. 

Isibonelo  2:   Abasebenzi esele basebenze embusweni iminyaka eminengi, kungenzeka batlhayele ngelwazi lamanye amakoro womsebenzi wabo. 4.4.8	Umsebenzi usebenza ngokuthembeka nangendlela yokuziphendulela nakasebenza ngeemali zombuso, begodu ipahla yombuso nezinye iinsetjenziswa ukusebenzisa kuhle, futhi akusebenzisele umsebenzi kwaphela. 

Umphakathi uyabathemba abasebenzi bombuso, ngalokho-ke uliselela ipahla yombuso, neemali zombuso, nalo loke ilifa lombuso ezandleni zabo, ngethemba lokuthi bazakuphatha kuhle nangokuthembeka. 
Abasebenzi kulindeleke nokobana basebenzise imali nepahla yomBuso ngokuyibabalela, ngendlela ezakwenza abatheli bomthelo basizakale. Kuqakathekile ukuthi abasebenzi balimuke ukuthi nayiyincani imali esetjenziswa mBuso, ayavuleka namathuba wokuthi umBuso abantu uzabenzela umsebenzi ongcono ngemadlana ekhona leyo. 

Isibonelo 1:  Umsebenzi nakanomtjhini wefeksi, akukafaneli bona anande athumela namkha amukela amafeksi wezinto zakhe zangeqadi unga ngewomsebenzi.  Umsebenzi nakafuna ukuthumela ifeksi yangeqadi, kufuze bona athole imvumo yokwenza njalo, begodu kufuze nokuthi akubhadalele ukusebenzisa kwakhe umtjhini wefeksi.

4.4.9	Umsebenzi uphakamisa ihlelo lokuphatha elihle, nelenzela izinto emkhanyweni, nelinokuziphendulela.

Ukuphakanyiswa kwehlelo lokuphatha elihle, nelenzela izinto emkhanyweni, nelinokuziphendulela, kutjho ukuthi esinye nesinye isakhamuzi kufuze bona sibe nethuba elilinganako lokusizwa kuhle nangomoya omuhle, ngaphandle kokukhetha amajamo wesakhamuzeso, nokuthi simumuntubani, nokuthi simhlobobani, njll. 
Ekwenzeni kwakhe umsebenzi wakhe kuhle, ngendlela enokuziphendulela okuhle, kufuze bona kuhlalwe kuqalelelwa iinrhuluphelo nekambisolawulo yomThethosisekelo. Abasebenzi kufuze bahlale ngaso soke isikhathi balinga ukuqeda umsebenzabo ngaphandle kokuriyada, kanti godu kufuze nokuthi bahlale ngaso soke isikhathi balinga ukwenza umsebenzabo ube ngewezinga eliphezulu, ngitjho nanyana umsebenzi loyo ungabonakala ungakaqakatheki namkha ungazisi.

4.4.10	Umsebenzi nakasemsebenzini kufuze bona abikele abaphathi abafaneleko nakube kunobukhwabanisa, ubukhohlakali, ukudlisana ngobuhlobo, ukwenza izinto ngendlela engasiyo namkha nanyana yini ephambene nokulunga namkha ephambana nekarekelo yomphakathi. 

Ubukhohlakali kutjho kuphelelwa komuntu bubuntu bakhe, khulu khulu ukuthenga umuntu namkha ukukhwabanisa. Kuvamise ukukhambisana namanye amacala wobulelesi, njengokufaka umoya wokurhweba ngeendakamizwa nje, nokukhukhuthisa iindakamizwa, nokwenza unga kunabasebenzi babe bangekho, ukukhwabanisa kunye nobulelesi obuhlelelweko obungahle bukhisimeze amandla womnotho. 4.4.11	Umsebenzi kufuze anikele iseluleko ngokuthembeka nangaphandle kokutjhigamela ncanye ngalo loke ilwazi elikhona nelaziwako eenkhulwini nakube zimbawa isizo elinjalo. 

Abasebenzi nababawiwa ukuthi baluleke iinkhulu ngananyana yini, kufuze bona lokho kwenziwe ngokuthembeka, nangokulandela umthethokambiso wefundiso yokuziphatha kuhle emsebenzini. 4.5	UKUZIPHATHA KOMUNTU NEKAREKO/NETJISAKALO YANGEQADI

4.5.1	Umsebenzi nakasemsebenzini wembatha abe aziphathe ngendlela ephakamisa isithunzi seKoro yabaSebenzi bomBuso.

URhulumende nomphakathi balindele izinga eliphezulu lokwenziwa komsebenzi ngendlela yokufundiseka nokuziphatha kwabasebenzi bombuso. 4.5.3 	 	Umsebenzi akakavunyelwa ukuvuma izipho zangeqadi, ukuvuma obunye Ubuhle enzelwa bona ngeqadi (obuhlathululwa njengesipho semali edlulako ku-R350) namkha ukuvuma ukuthengwa mumuntu ngemali namkha ukuvuma ukuthathela omunye isipho namkha izipho emsebenzini ngaphandle kokuthola imvumo etlolwe sikhulu somnyango ntanzi, njengoba koke lokhu kungathathwa njengokuthengwa nje. 

Umuntu nakaqatjhelwe ukusebenza njengomsebenzi wombuso kutjho ukuthi uqatjhelwe isikhundla somsebenzi esikhethekileko. Ukuvuma izipho namkha okhunye okungaba namandla wemali kunanyana ngubani namkha kinanyana ngisiphi isijamiso esifuna ukwenza umsebenzi othileko embusweni, namkha esenze umsebenzi othileko olawulwa msebenzi wabasebenzi bombuso, kungavumakala kwaphela nakuvunyelwe ngemvumo etloliweko yesiKhulu somNyango loyo la kwenziwa khona umsebenzi namkha imisebenzi leyo. 

Kuqakathekile ukwazi ukuthi izipho namkha obunye nje ubuhle obenzelwa umsebenzi wombuso obubuya emuntwini wangaphandle - ongasimndeni nomsebenzi wombuso loyo - kufuze bona kuvezwe, kwaziswe. Izipho ezivezwako ngezemali engaphezulu kwe-R350. Abasebenzi-ke bangayokubuzisisa ku-Public Service Commission la banganaqiniso khona ngezipho ezibuya ebantwini.  

4.5.4 	Umsebenzi akukafaneli bona asebenzise namkha aveze imininingwana yelwazi lembusweni ukuzitholela inzuzo namkha ukutholela abanye inzuzo. 

Abasebenzi abathi basemsebenzini bahlangabezane nelwazi elilumelako, elisifuba namkha eliyifihlo imbala, akukafaneli ukuthi ilwazi elinjalo baliveze komunye umuntu ngaphandle kokuthola imvumo efaneleko yokwenza njalo. Ilwazi akukafaneli ukuthi lisetjenziselwe ukuzitholela inzuzo, namkha ukutholela omunye/abanye inzuzo namkha ukusozisa abanye, namkha ukuzibuyiselela kabanye.  Kuqakathekile ukuthi abasebenzi bazibuze bazibuzisise ntanzi ukuthi ilwazi ellithileko nalivezwako lizawusiza njani umphakathi.  Abasebenzi kufuze balimuke ukuthi ukwenzela izinto emkhanyweni akutjho ukukhambe uneka ilwazi nanyana ngiliphi tjhatjhalazi ngokufuna komuntu.  Njengoba kungeke kwakghonakala ukuhlukanisa koke ukuthi ngiliphi ilwazi elingavezelwa ubani, abasebenzi balimukiswa ukuthi bathome ngokuyokubuza iinkhulu zabo ntanzi ngeendaba abanganaqiniso ngazo ukuthi ngezivezwako namkha ngezingavezwako, nokuthi zingavezelwa bani. 

Isibonelo 1:  Ukuvezwa kwendlela yokukhetha ukuthi ngubani olungele umsebenzi namkha ukuvezela abanye abantu abafuna umsebenzi imibuzk abazokubuzwa yona nabalingelwa umsebenzi loyo angeke kube sisenzo esingakalungi nje kwaphela esisiza abanye abafuni bomsebenzi ngokungasimthetho, kodwa kuzakubuye kuphule namalungelo wabanye abantu abafuna umsebenzi, ngoba bazabe sebadimeke amathuba wokuphalisana ezingeni elilinganako nalabo abazabe sebakhanyiselwe indlela ngomsebenzi loyo.

4.5.5 	Umsebenzi akukafaneli ukwenza umsebenzi ombhadalako ngaphandle komsebenzi wakhe osemthethweni namkha asebenzise iinsetjenziswa ze-ofisakhe ukwenza umsebenzi onjalo, ngaphandle kwemvumo. 

Abasebenzi balindeleke ukuthi benze umsebenzabo ngengqondo epheleleko, nangelwazi lekghono labo elipheleleko nabenza umsebenzi wabo wembusweni. Ubunjalo bomsebenzi weKoro yabaSebenzi bomBuso bungendlela yokuthi ikoro yembusweni kunye nomphakathi bangakhisimezeka nange umsebenzi wembusweni angazenzela omunye umsebenzi wangeqadi abhadalelwa wona, ngesikhathi sakhe. Ngalokho-ke umsebenzi ukatelelekile ukuthi athole imvumo ntanzi yokwenza umsebenzi abhadalelwa wona ngesikhathi sakhe.  
 
Isibonelo 1:  Umsebenzi othileko uba ngomunye onesabelo ebhizinisini ethileko. Kuvunyelwana ngokuthi uzakuba sebhizinisini leyo sele atjhayisile emsebenzinakhe wembusweni. Ukukhambisana nokuthobela umThetho kulindeleke ukuthi kuphakamise indlela yokusebenza ngendlela enefundiso, nokusiza ukuqinisekisa ukuthi umphakathi unethemba ekorweni yabasebenzi bombuso. 

B. 	ISINGENISO 

B.1	Kuyafuneka ukuthi abasebenzi bakhonjwe indlela ngobudlelwana babo nomthetho, neemphathimandla zepolitiki nezama-ofisi, nabanye abasebenzi kunye nomphakathi, kutjengiswe nanomoya abasebenzi ekufuze benze ngawo umsebenzabo, kutjengiswe nokuthi kufuze kwenziweni ukubalekela ukurarana kweenrhuluphelo, kuvezwe nokuthi yini elindeleke kibo ngesibona ngokuziphatha kwabo epilwenabo yangeqadi. 

B.2	Nanyana umThetho weRhelo lokuziPhatha watlanyelwa ukuthi ube nakho koke ongakghona ukuba nakho nje, kodwa nokho awukayiphathi yoke yoke imithetho elawula izinga nendlela yokuziphatha. Nokho-ke iinkhulu zeminyango ngokwahlukahlukana kwayo, ngesibopho sazo somsebenzi ngokwesekhtjheni 7(3)(b) yomThetho wokuphatha nokulawula okuhle nokukhalimeka kwabasebenzi eminyangweni yombuso, hlangana nokhunye, zinesibopho sokwenza iqiniso lokuthi indlela abasebenzi abaziphatha ngayo ikhambisana nemithethokambiso nekambisolawulo elawula iinjamiso zombuso namazinga wokusebenza ekufuze zisebenze ngawo, njengoba kusitjho umThetho. Iinkhulu zeminyango kufuze zenze iqiniso lokuthi abasebenzi abangaphasi kwazo bayayazi imithetho nekambiso le, benze neqiniso lokuthi bayayivuma, babe bayihloniphe.
