uMphathiswa weSebe Lemicimbi Yabasebenzi uwuphumezile umgaqo-nkqubo obizwa ngokuba Kukwenza Okulungileyo Ekuqeshweni Kwabantu Abakhubazekileyo ngokwemigaqo yomthetho iEmployment Equity Act, ka-1998.
Le Code ijoliswe ekufundiseni nasekwaziseni abaqeshi nabasebenzi ukuze bawazi amalungelo noxanduva abajongene nalo ekuphakamiseni ukutyhilekelwa kwanokunciphisa iimbambano ukuze abantu abakubazekileyo babe nakho ukonwabela ze basebenzise amalungelo abo kwiindawo zabo zempangelo.
INDLELA ABACHAZWA NGAYO "ABANTU ABAKHUBAZEKILEYO"
Ngokwalo Mthetho eyona nto kujoliswe kuyo ziziphumo zokukhubazeka kuloo mntu ngokungqamene nomsebenzi wakhe ngaphezu kokuba ukhubazwa yintoni na okanye kwizinto angenakukwazi ukuzenza.
Abantu babonwa "Bengabantu Abakhubazekileyo" abamelana nazo zonke iindlela zale ngcaciso:
abakhubazeke ngokwasemzimbeni okanye ngokwasengqondwemi kukhubazeka oko kuhlala kukho okanye kuhamba kubuye, ze nto leyo ibabambezelayo ekubeni bangene kwizithuba zempangelo okanye ekubeni bakhule empangelweni.

Abaqeshi kufuneka baqinisekise ukuba iimvavanyo azibakhupheli ngaphandle ngendlela engekho mthethweni imiqathango yaye kufuneka indlela ekwenziwa ngayo izinto ingakhethi cala kwindlela ekuchongwa ngayo, ekuhlolwa nekuchazwa ngayo imigaqo.
Uvavanyo lobume bempilo yomntu kufuneka lwenziwe kuphela emva kokuba umqeshi lowo efumanisile ukuba umfaki-sicelo lowo uyakwazi ukuwenza okanye uyamelana neemfuno zaloo msebenzi yaye emva kokuba ewunikiwe loo msebenzi.
UQEQESHO NOKUKHULA EMSEBENZINI
Abantu abakhubazekileyo kufuneka kuthetha-thethwane nabo kwimicimbi yokukhula nokuphuhla kwabo emisebenzini, zithathelwe iingqalelo iimfuno zabo ezizodwa yaye kufuneka bafikelele nakwizixhobob zoqeqesho. Ukuhlolwa komsebenzi wabo kwakunye nezibonelelo zokugqwesa emsebenzini kufuneka zibonakalise ngokucacileyo ze zilinganisele indlela abazinikele ngayo kweyona misebenzini yabo.
UKUGCINA ABANTU ABAKHUBAZEKILEYO
Abasebenzi abathi bafunyanwe kukukhubazeka ngexesha lomsebenzi kufuneka, apho kukwazekayo, babuyiselwe emisebenzini. Ukuba kuya kuba ngcono ngolo hlobo, abaqeshi kufuneka bazame iqhinga lokubanika aba basebenzi eminye imisebenzi enokubafanela, umsebenzi oncitshisiweyo okanye bafakwe kwiindawo abaza kusebenza kuzo ngokukhululeka nalula, ukuze abasebenzi aba bangazifumani benyanzelekile okanye bekhokelelwa ekubeni bayiyeke imisebenzi yabo.
IMBUYEKEZO KUBANTU ABAKHUBAZEKILEYO
IMFIHLELO
Abaqeashi kufuneka baqinisekise ukuba ulwazi neenkcukacha ngokukhubazeka ezinikezelwe ngumsebenzi okanye umfaki-sicelo kwisithuba sengqesho zihlala ziyimfihlelo. Kufuneka umqeshi lowo aqinisaekise ukuba konke oku kwenziwa ngononophelo olukhulu ukuze ezo nkcukacha ziyimfihlelo zihlale zinjalo yaye zahluke kwezinye nje ezingeyomfihlelo.
Abaqeshi abavumelekanga ukuba badize naluphi na ulwazi olunento yokwenza nokukhubazeka komsebenzi ngaphandle kwemvume yaloo msebenzi ebhalwe phantsi, ngaphandle kokuba bayalelwa ngumthetho ukuze benze oko.
IZIBONELELO KUBASEBENZI
Abaqeshi abanikezela okanye abenza amalungiselelo okukhusela abasebenzi kwiingozi zengqesho okanye izicwangciso zezinye nje izibonelelo kufuneka baqinisekise ukuba ezo zibonelelo azibenzi abo basebenzi bazive bengafani nabanye abantu, ngendlela ethe ngqo okanye egwegwelezayo.
UCWANGCISO LOKULINGANA EMSEBENZINI
Ukuba abantu abakhubazekileyo abamelwanga ngokulingana nabanye abantu kuwo onke amanqanaba namabakala engqesho, umqeshi lowo kufuneka acele umkhomba-ndlela kwimibutho emela iimfuno zabantu abakhubazekileyo okanye iingcali kwelo candelo, umzekelo, inkonzo yokunuyiselwa kwengqondo yomntu emsebenzini nonyango lwezigulo zasemsebenzini ukuze abantu abakhubazekileyo bakwazi ukumelana neemfuno zale misebenzi.
