UmThetho weTjhebiswano lezabaSebenzi ka-1995 uvumela ilungelo lokuphiketha. Iyuniyoni yabasebenzi etlolisiweko ingagunyanza ukuphiketha kwamalunga nabasekeli bayo ngomnqopho wokutjhagala ngokuthula.

Iphikethi ingabanjelwa kwenye nenye indawo lapho umphakathi unokufikelela, kodwana ngaphandle kwendawo yomqatjhi namkha ngemvumo yomqatjhi ngaphakathi kwendawo yomqatjhi.

Iyuniyoni etlolisiweko namkha umqatjhi angabawa i-Commission for Conciliation, Mediation and Arbitration  ukulinga ukuvikela isivumelwano hlangana kwabathinteka embangweni ngemithetho okufanele isetjenziswe kwenye nenye iphikethi mayelana nokunghala umsebenzi namkha ukuvalelwa ngaphandle. Nayikuthi akufikelelwa esivumelwaneni, i-CCMA kufanele yenze imithetho yokuphiketha, itjheje ubujamo obuthileko bendawo yokusebenzela namkha irhelo lokuziphatha kuhle elikhona.

Imithetho ingavumela abasebenzi ukuphiketha endaweni yomqatjhi nayikuthi i-CCMA ibona ngathi umqatjhi bekangazwisisi kuhle ekwaleni kwakhe ukuphiketha ngaphakathi kwendawo yakhe.

Amagadango okufanele alandelwe

Iyuniyoni etlolisiweko namkha umqatjhi angazalisa iforomo LRA 4.1 ukubawa i-CCMA ukuvikela isivumelwano semithetho yokuphiketha ngesikhathi sokunghala umsebenzi namkha sokuvalelwa ngaphandle.Nikela omunye othintekako ikhophi yeforomeli.
Nikela ubufakazi bokobana ikhophi yeforomeli inikelwe omunye othintekako ngokunamathisela:

o ikhophi yeslibhu sokurejista esibuya eposweni
o ikhophi yerasidi elitlikitliweko nayikuthi iforomo lalethwa ngesandla

o ikhophi yesiqinisekiso sefeksi namkha obunye ubufakazi obanelisako.
Thumela iforomo elizalisiweko ku-Registrar: Provincial Office of the CCMA.
Nayikuthi badlula munye abathinteka embangweni, namkha umbango uqaliswe kwabadlula munye, tlola phasi amagama amanye nemininingwana ekhasini elinye bewulinamathisele eforomoni.
