YINTONI URHWEBO NGABASEBENZI?

Urhwebo ngabasebenzi kukubonelela ngabasebenzi bezingxungxo okanye abasebenzi bethutyana olwenziwa ngumntu okanye inkampani komnye umntu okanye inkampani ngenjongo zokufumana imali. Umrhwebi ngabasebenzi ngumntu okanye inkampani ebonelela ngale nkonzo.

Urhwebo ngabasebenzi lufana nento ngokunje ebizwa ngokuba ziiNkonzo zeziNgxungxo (Temporary Employment Services- TES ). Eli candelo likhule ngokummangalisayo kwizwelonke. Ngoko ke abasebenzi baqeshwa ngokobuqu baze baphinde bagxothwe ngumfama ngokwemfuno zabo zaloo maxesha. Ekuhambeni kwexesha, abarhwebi ngabasebenzi baye bangenelela ukuze babonelele ngeenkonzo zamaqela okukha izivuno, okanye abavuni. Ukukhula okumandla kweeTES kwiindawo zemisebenzi yale mihla kuphenjelelwe ziimfuno ezikhulayo zeendlela yeenkqubo eziguquguqukayo zemisebenzi, ukukhawulelana, umzekelo:

Ukungezi kwabasebenzi emsebenzini, ixesha elifutshane okanye elide (eligqitywe ngenxangaphambili)
Ukutshintsha-tshintsha kwamaxesha kwiimfuno zeemveliso
Imfuno yexeshana yabasebenzi abanezakhono ezinqabileyo

Kukho umthetho okhoyo ongquzulana noshishino lokurhweba ngabasebenzi. Nakuba kungekho mntu omakanyanzeliswe ukuba afumane umsebenzi ngomrhwebi wabasebenzi, ngoko ke, xa sithetha inyaniso abantu abanezakhono ezingephi, ezifana nezabasebenzi bamaxesha athile onyaka, bangakufumana kunzima ukufumana umsebenzi ngaphandle kokusebenzisa umrhwebi wabasebenzi.

I-Labour Realtions Act 66 we -1995

I-Labour Relations Act iyayichaza imigaqo nemimiselo yeenkonzo zomsebenzi wethutyana. Yenza ulungiselelo lokuzibophelela kubarhwebi ngabasebenzi. Ngokwa lo Mthetho, umthengi kunye nomrhwebi ngabasebenzi kufuneka bathobele imithetho elawula ezabasebenzi. Njengalo onaliphi na ishishini, abarhwebi ngabasebenzi abanakuluphepha nalo naluphi na uhlobo lomthetho wezabasebenzi.

I-Basic Conditions of Employment Act 75 we 1997 (BCEA)
I-Basic Conditions of Employment Act (BCEA) ibeka iimfuneko ezimbalwa zokulindelekileyo njengokuba abaqeshi kufuneka badibane xa besenza isivumelwano nabasebenzi. Nasiphi na isivumelwano esisayinwe ngumqeshi nomqeshwa akufuneki sichasane ne-BCEA.

I-Skills Development Act 97 we -1998   

I-Skills development Act ifuna ukuba nawuphi na umntu okanye ishishini elinqwenela ukubonelela ngeenkonzo zengqesho libhaliswe. Abantu ababonelela ngeenkonzo zengqesho, umz. abarhwebi ngabasebenzi, basenokubhaliswa kuphela xa bethe baluphumelela uludwe lweemfuno ezithile ezilindelekileyo ezichazwe kuMthetho lowo.

I-Compensation for Occupational Injuries and Diseases Act 130 we -1993

Ngokwalo Mthetho, abasebenzi kufuneka babuyekezwe ngalo naluphi na ukhubazeko/ukulimala okwenzeke okanye nasiphi na isifo esifunyanwe ngenxa yokwenza umsebenzi wabo. Lo mthetho ubonelela nangembuyekezo xa kuthe kwakho oswelekayo ngenxa yomonzakalo okanye izifo ezinjalo.

IMIBA ETHILE ENGUNDOQO EPHATHELELE KURHWEBO NGABASEBENZI  
Abarhwebi ngabasebenzi Benza ibango lokuba bona abangabo abaqeshi kuloko banabaxhasi abababonelela ngeenkonzo, umz amafama. Kwelinye icala amashishini wona asebenzisa iinkonzo zabarhwebi ngabasebenzi benza ibango lokuba abarhwebi ngabasebenzi ngabona baqeshi babasebenzi. Le nto ibangela ukudideka kubasebenzi bona abazifumana bentyumpantyumpeka kwezi mpixano. 

Abasebenzi abaqashwe ngokusebenzisa abarhwebi ngabasebenzi bangasemngciphekweni kakhulu xa benokthi balimalele emsebenzini. Ngubani oza kuthatha uxanduva lwemiba yempilo neyokhuseleko kunye nemiba ephathelele kwimbuyekezo?

Nangona abarhwebi ngabasebenzi bebonelela ngamathuba omsebenzi kubasebenzi bezingxungxo, iingenelo yezingxungxo ayinazingenelo ezifana nezo zixhanyulwa ngabasebenzi abasisigxina afana nekhefu, umvuzo kunye nomhlala-phantsi.

Abasebenzi bezingxungxo kufuneka ngamaxesha amaninzi besayine izivumelwano zokuba ukuba umntu akayanga emsebenzini, akazi kufumana nokuba iingenelo zimbalwa kunezo zabasebenzi abasisigxina.




IIMPEMBELELO ZOMSEBENZI ONDILISEKILEYO: ITHETHA UKUTHINI?

UMbutho wabaSebenzi weZizwe ngezizwe (International Labour Organisation (ILO)) kunye namagatya awo abalulekileyo bayile ingqikelelo ethi uMsebenzi oNdilisekileyo (Decent Work). La magatya abalulekileyo aquka oorhulumente, abaqashi kunye nemibutho yabasebenzi. I-ILO iyixhasile le-Ajenda yoMsebenzi oNdilisekileyo ukusukela kunyaka we -1999. Injongo yale-Ajenda kukonyusa uphuhliso loluntu kunye nokulwa ubuhlwempu.

UMsebenzi oNdilisekileyo yinto abantu abafuna ukuyiphumeza kwiintsuku zabo zemisebenzi. Isukela kwinto yokuqonda ukuba umsebenzi sisiseko sesidima somntu, kuquka namathuba alinganayo kunye nokuphathwa kwawo onke amadoda nabafazi.

Injongo yomsebenzi ondilisekileyo ku:
kwenza wonke umsebenzi abe nomvuzo owenza kubekho ubomi obundilisekileyo
kunika amathuba alinganayo okuziphuhlisa
kwenza iimanyano zabasebenzi zibe nelizwi kwimiba yezemisebenzi.

I-Ajenda yoMsebenzi oNdilisekileyo iphunyezwa ngobuchule beenjongo ezine: 
Ukudala imisebenzi
Ukuqonda nokukhusela amalungelo emisebenzini
Ukwandisa ukhuseleko loluntu, oko kukuthi abafazi namadoda babe nemisebenzi ekhuselekileyo kunye nokuhlawulwa ngokufanelekileyo.
Ukukhulisa ingxoxo nokusonjululwa kwembambano, oko kukuthi ukunika imibutho yabasebenzi indima enkulu ekuthinteleni ukungaboni ngasonye emsebenzini.
