Lixesha apho amaqela ajongene nomceli-mngeni ofanayo wokwakha nokutshintsha i-DHA yangoku ibe liSebe leMicimbi yezeKhaya elitsha ukuphucula ukufikelela, ubunzulu, izibonelelo zokusebenza, ukusebenza, inkuthalo nexabiso lokunikezwa kwenkonzo malunga nemisebenzi eyenziwa yi-DHA, ekubeni ngaxeshanye ukwandisa ingqesho nokuphucula ukusebenza, uqeqesho kunye nophuhliso lwabasebenzi, ixabiso nokuzinza kwemisebenzi yabasebenzi be-DHA okubalulekileyo kutshintsho oluyimpumelelo lwe-DHA.  

Amaqela avuma ukuba anokuzibophelela okufanayo kumdla obanzi wokunika iimfuno zophuhliso zeLizwe neSizwe soMzantsi Afrika. Aqhubeka avume ukuba uMgaqo-siseko ufaka amalungelo abo bonke abantu kwiRiphabliki kwaye ungqina iimpawu zentsulungeko zedemokrasi zesidima, ukulingana kunye nenkululeko. UMgaqo-siseko ubeka umsebenzi kuRhulumemente ukuhlonipha, ukuphakamisa nokuzalisekisa onke amalungelo njengoko kufakwe kuMqulu waMalungelo oLuntu.

Ngokunjalo amaqela abhale phantsi ngqo ingxelo zawo zokuzibophelela kwawo kunikezo olusebenzayo lwenkonzo karhulumente kwi-DHA, eqinisekisa ukuba iinkonzo eziyimfuneko ziyanikezwa kubahlali nabasebenzisi malunga nemisebenzi eyenziwa yi-DHA, kunye nolawulo loLuntu oluyimpumelelo nosetyenziso olukwiqondo eliphezulu lokusetyenziswa kwezibonelelo. Ukukhawulezisa ukunikezwa kweenkonzo ngokungqinelana nemithetho-siseko yolawulo loLuntu eyaxhaswa kuMgaqo-siseko nakuMgaqo-nkqubo weBatho Pele. IINKCAZELO

“Izithuba ezikudidi-A” zizithuba ezikwinqanaba le-9 ukuya kwele-12 kwisakhiwo esitsha.

“Izithuba ezikudidi-B” zizithuba ezikwinqanaba lesi-8 nangezantsi kwisakhiwo esitsha, kodwa akubandakanywa izithuba eziphantsi kodidi-A.

“I-NEHAWU” ithetha iManyano yeSizwe, ezeMfundo, ezeMpilo kunye naBasebenzi abaManyeneyo.

“Ukubekwa” kuthetha ukubeka umsebenzi okhoyo kwisikhundla kwisakhiwo esitsha.

“I-PSA” ithetha uMbutho weNkonzo kaRhulumente, iManyano yorhwebo ebhalisiweyo.

3.	UKUQWALASELA KWAKHONA NENJONGO YESIVUMELWANO 

3.1	URhulumente waseMzantsi Afrika uzibophelele ekuxhobiseni abantu bakhe ukusuka kwiintsuku zabo zokuqala ukuya kutsho kwezokugqibela ngamaxwebhu alungileyo, nangokuxhasa ukhulo nokhuseleko ngokwenza abantu abanesakhono, abakhenkethi kunye nabandwendweli babe nako ukuba negalelo kuqoqosho lwethu.

3.2	I-DHA inika uluhlu olubanzi lweenkonzo kwilizwe lonke. Umzekelo, ngelungiselelo lobhaliso lokuzalwa nangezazisi, isebe lenza abantu babe nako ukuba nokufikelela kwiinkonzo zikarhulumente ezisisiseko. Ikwanika amaxwebhu ayimfuneko abandwendweli abanqwenela ukwenza ushishino kweli lizwe kwaye iququzelela ungenelelo njengommi lwabantu abanezakhono ezinqabileyo elizweni. 3.3	Ngazo zonke ezi ndlela ziphambili zisengqondweni, urhulumente utyale izibonelelo eziluqilima kutshintsho olugqibeleleyo lwe-DHA uKwakha iSebe leMicimbi yezeKhaya elitsha ukuze kuqinisekiswe ukuba iSebe linikeza iinkonzo eziqhelekileyo kuluntu, ezingenabuqhophololo nezisebenzayo kubo bonke abasebenzisi ngokuhambelana neempawu zentsulungeko nemithetho-siseko emiswe kwicandelo le-195 (1) loMgaqo-siseko weRiphabhiki yoMzantsi Afrika.

3.4	INkqubo yoGuquko iya kulinga ukuphumeza oku phakathi kwezinye ngoku: 

	3.4.1	phucula inkqubo yokusebenza yesebe; 

	3.4.2	lungelelanisa ngcono isakhiwo sayo kwimisebenzi yalo; 

	3.4.3	phucula izibonelelo zokusebenza zesebe;

3.4.4	ukwandisa ngokuthe chu into efunekayo yokufezekisa abasebenzi balo ukunika iinkonzo zikarhulumente ezisebenzayo nezineziphumo; kunye noku 

3.4.3	phucula nokuphuhlisa isiphiwo sabo bonke abasebenzi, kubandakanywa nangokukodwa abasebenzi abakulawulo.

3.5	Ukusebenza kunye nenkuthalo yabasebenzi be-DHA iyakuphuculwa phakathi kwabanye ngo:

	3.5.1	qeqesho, uphuhliso nokuxhotyiswa kwabasebenzi; noku

3.5.2	qinisekisa ukuba abantu abanobuchule okanye ukubanako ukuzuza izakhono ezilungileyo nobuchule bafakwa kwizikhundla ezilungileyo.

3.5.3 	kuqinisekisa ukuba abantu  abanobuchule obulungileyo baphuhliswe apho basilela khona kwixesha eliya kumiswa yi-DHA kwingcebiswano nomsebenzi kunye/okanye nemanyano yorhwebo.

3.6	Injongo yesi Sivumelwano sokuGuquka kukuphumeza phakathi kwezinye izinto, 

3.6.1	inkqubo yokufuduka kwabasebenzi abaqeshwe kwinqanaba le-12 nangaphantsi kwizikhundla kwisakhiwo sombutho esidala ukuya kwizithuba ezikwisakhiwo sombutho esitsha khon’ukuze bahlangabezane neenjongo eziphambili zeNkqubo yokuGuquka njengoko ziqulathwe kwisivumelwano.  

3.6.2	iindlela zokusebenza, iinkqubo, neendlela ezilawula iziphumo zenkqubo yokuGuquka kubasebenzi, kubandakanywa uqeqesho neenkqubo zophuhliso nokhuseleko lwengqesho kunye neziqinisekiso zokhuselo lwengeniso.

3.6.3	ukuqinisekisa ukuba akukho mntu uqeshwe yi-DHA uyakudendwa njengesiphumo senkqubo yokuguquka.



4.	UMDA WESICELO.

4.1	Esi Sivumelwano sibhekisa kubasebenzi abaqeshwe kwi-DHA kwinqanaba le-12 nangaphantsi.

	4.2	Esi Sivumelwano sibophelela:

		4.2.1	umqeshi;

4.2.2	Iimanyano zorhwebo ezisayine isigqibo kwesi Sivumelwano nabo bonke abasebebenzi abaphantsi komda obhalisiweyo we-GPSSBC abaqeshwe kwi-DHA kwinqanaba le-12 namgaphantsi.

4.2.3	malunga necandelo lama-23 (1)(d) le-LRA, bonke abanye abasebenzi bomqeshi abangengomalungu emanyano ebhalisiweyo eliqela kwesi Sivumelwano nabaqeshwe kwi-DHA kwinqanaba le-12 nangaphantsi.[1]



5.	INDLELA YOKUZIPHATHA

5.1	Amaqela mawabambelele kule mithetho-siseko yokuziphatha kuyo yonke inkqubo yokuguquka kwanokubekwa.

5.2	Kwesi siphelo, i-DHA, amaqela emanyano yorhwebo kwesi sivumelwano, amalungu awo kunye nabasebenzi be-DHA, ukongeza kwiimfanelo ezisemthethweni eziqhelekileyo zabo ma:

5.2.1	Babambelele kwimithetho-siseko, izikhokelo neendlela eziqulathwe kwesi Sivumelwano. 

5.2.2	Basasaze lonke ulwazi olusekwe kwizinto ezikhoyo hayi ukuthekelela. 

5.2.3	Balwele ukufikelela kwimvumelwano apho izigqibo zifunwayo. 

5.2.4	Benze ngendlela ekholisa kakhulu i-DHA, abasebenzi bayo neemfanelo zayo zokunikezwa kwenkonzo. 

5.2.5	Basebenze ngendlela ehloniphekileyo nenembeko komnye umntu. 

5.2.6	Babephantsi kweCandelo le-16 le-LRA, ukungaxelwa kolwazi oluyimfihlo. 

5.2.7	Babonise umnqweno wabo, ukuzibophelela nenkuthalo yokwakha i-DHA entsha. 

5.2.8	Banike isaziso esizeleyo sokungakwazi kwabo ukuya entlanganisweni okanye ukwenza amaxesha amisiweyo, kwaye bayakuyeka ekwenzeni njalo apho kunokuphetshwa ngokufanelekileyo. 

5.2.9	Baxele  phandle zonke iimbambano ezinokwenzeka baze bazikhuphele ngaphandle bona apho kukho okanye kubonakala ikukuphelelwa ngumdla.



6.	IMITHETHO-SISEKO YOKUFUDUKA NEENJONGO EZIPHAMBILI

Ukuguquka nenkqubo yokufuduka mayikhokelwe, phakathi kwezinye ziinjongo eziphambili nemithetho-siseko elandelayo.

6.1	Ukuqinisekisa ukunikezwa kwenkonzo okungaphazanyiswanga nokulandelelanayo ngexesha lokuguquka nokufuduka kwanokuqhelisa abasebenzi kwizakhiwo zombutho omtsha. 

6.2	Ukuququzelela okona kusetyenziswa kwabasebenzi nokukhulisa amandla abo ophuhliso.

6.3	Ukwenza kakuhle, ngokungaguqukiyo nangokufanelekileyo.

6.4	Ukulungiselela indlela elungileyo neselubala enciphisa amabango neembambano nenika ingqiniseko kubasebenzi kuyakwenzeka ngokufanelekileyo. 

6.5	Ukunxibelelana rhoqo nabasebenzi ukudambisa uloyiko nokungaqiniseki kunye nokuxhasa jikelele ukuthatha inxaxheba okwakhayo kwinkqubo. 

6.6	Ukunika isiphumo kwizakhono zophuhliso ze-DHA neenjongo eziphambili zobulungisa bezengqesho nezicwangciso, nokubalungelelanisa apho kuyimfuneko.

6.7	Ukunika ilungelo eliphambili nokulawula ukufuduka kwabasebenzi abakhoyo njengokulungileyo nokwenzeka ngokufanelekileyo.

6.8	Ukulungiselela inkqubo apho i-DHA iyakuba nobulumko bokubeka umntu naphi na kwiSebe ngokucebisana nalo mntu okanye imanyano yorhwebo yakhe esekwe kwiimfuno zokusebenza ze-DHA.

6.9	Umsebenzi uyakubekwa kwinqanaba elisezantsi kunelo libanjwe ngumsebenzi onjalo ngoku.

6.10	Ukubekwa kwindawo entsha kuyakwenziwa ngokungqinelana nemigaqo-nkqubo yokusiwa kwindawo entsha eqhelekileyo kwiNkonzo kaRhulumente.

6.11	Ukufuduka kuyakusebenza ngokungqinelana neprofayili yezakhono zomsebenzi nangokuqwalaselwa komthetho-siseko wokuvalwa kokudityaniswa. 

6.12	Nika intsingiselo kumthetho-siseko wokuphakamisa intsebenziswano kwi-DHA nolwabelwano ngolwazi, phakathi kwezinye izinto ngokuba ube nokuguquguquka xa ubandakanya abasebenzi kwezinye iindawo apho bangabamba izakhono okanye bazifumane ngexesha elifanelekileyo. 

6.13	Ukunyanzelisa umthetho-siseko onemfanelo ekwenzeni nase kuxhaseni izithuba ezingenalungelo lakubhangiswa kuchongo olusisigxina kwezo zithuba kwisakhiwo esitsha. 

6.14	Ukuqinisekisa ukuba izibonelelo zokusebenza ezoneleyo nezifanelekileyo ziyanikezwa ukulungiselela isicelo esinobuchule sesi Sivumelwano. 

6.15	Ukuqinisekisa unikezo lwenkonzo oluphucukileyo.



7.	IIMVAVANYO ZOBUCHULE

7.1	Bonke abasebenzi abakwizithuba ezikwinqanaba le-9 ukuya kwele-12 kwisakhiwo esidala mabaye kuvavanyo lobuchule kwiqela elithenjiwe neliqinisekisiweyo kwaye kuyakufuneka baye kudliwano-ndlebe lobuchule.

7.2	Iziphumo zovavanyo lobuchule ziyakusetyenziswa njengesixhobo sokuphuhlisa iimfuno zoqeqesho nophuhliso zomsebenzi.

7.3	Malunga nezicelo zaso neziphi izithuba ezingenamntu okanye ezitsha malunga noDidi-A lwezithuba, kufuneka umfaki-sicelo ukuba aye kuvavanyo lobuchule kwiqela elithenjiweyo neliqinisekisiweyo kwaye umfaki-sicelo kuyakufuneka aye kudliwano-ndlebe lobuchule. 







8.	UKUFUDUKA MALUNGA NODIDI-A LWEZITHUBA 

8.1	Kwisiphumo sesiqulatho somsebenzi wesithuba esibe notshintsho oluzinzileyo, oko kukuthi ama-50% okanye ngaphezulu, isithuba siyakuthathwa njengeso sesithuba esitsha kwaye imithetho-siseko eyimfuneko kwizithuba ezitsha iyakubakho. 

8.2	Kwisiphumo apho uvavanyo lomsebenzi lumise inqanaba lesithuba esohlukileyo, imigaqo-nkqubo jikelele neendlela kwiNkonzo kaRhulumente iya kubakho. 

8.3	Umntu wesithuba esitshintshileyo nongasilungelanga isithuba esitsha uya kubekwa kwisithuba kwinqanaba elinye kwiSebe. 

8.4	Ukufuduka kwabasebenzi bonke ukusuka kwisakhiwo esidala ukuya kwisakhiwo esitsha kuyakuqinisekisa ngokubhala okwenziwe yi-DHA.

8.5	Kwisiphumo sezithuba ezimbalwa ezikhoyo kwisakhiwo esitsha njengoko kuchaziwe kwisakhiwo esidala, uvavanyo lobuchule kunye nendlela ezakumiswa yi-DHA ngokucebisana neemanyano zakusetyenziswa njengendlela yokukhetha ukumisa ubeko. I-DHA iya kubonisana neemanyano kwi-TCF apho indlela exeliweyo itshintsha khona imeko zenkonzo yabasebenzi.

8.6	I-DHA iya kuba nobulumko bokubeka umsebenzi naphi na kwiSebe ngokusekwe kwiimfuno zokusebenza zalo emva kokubonana nomsebenzi kunye/okanye imanyano yakhe. Ukuba ulandulo lomntu onjalo alufanelekanga, i-DHA mayibize uncedo olufanelekileyo elungelweni layo. 



9.	UKUFUDUKA MALUNGA NODIDI-B LWEZITHUBA

Malunga nodidi-B lwezithuba, amalungiselelo esiqendu sesi-6 ngasentla ayakubakho ukulungiselela iimvavanyo zobuchule, ezingayi kubakho. 



10.	AMALUNGISELELO ABASEBENZI ABAZAKUBEKWA

	10.1	Uncedo lwabasebenzi abaseza kubekwa

10.1.1	Uncedo nodliwano-ndlebe lumele ukuqhutywa malunga nabasebenzi abaseza kubekwa ngenjongo yoku:

(a)	qinisekisa ukuba izigqibo ezilungileyo zingathathwa ngokunxulumene kokungakhethwa kuko kokubeka okunganika izakhono kwakhona okunokwenzeka. 

(b)	ukunika ingcaciso noncedo kubasebenzi abaseza kubekwa, 

10.1.2	I-DHA iyakuqinisekisa ukuba kukho unxibelelwano oluqhubekayo kubasebenzi abaseza kubekwa malunga nophuhliso kwinkqubo yokufuduka. 

10.1.3	Okulindelweyo, okunxulumene noku okanye neyiphi eminye imiba echaphazela abasebenzi abaseza kubekwa kumele ukulawulwa ngenyaniso, unxibelelwano lwarhoqo noluse lubala. 





11.	IPHANELI EBEKAYO

11.1	IPhaneli eBekayo iyakumiswa ukuze yongamele ukuphunyezwa kwenkqubo yokufuduka. 

11.2	Ukwakhiwa kwePhaneli

11.2.1	I-DG iyakuchonga abasebenzi abahlanu be-DHA, omnye wabo eyakuba nguSihlalo wePhaneli eBekayo. Ukongeza i-TCF iyakumisela usekela-sihlalo. 

11.3	Abakhi-mkhanyo

11.3.1	Iqela ngalinye lamaqela emanyano yorhwebo kwesi Sivumelwano liyakuchonga abakhi-mkhanyo ababini kwiPhaneli.

	11.4	Amagunya nemisebenzi yePhaneli

		Amagunya nemisebenzi yePhaneli ngala alandelayo:

11.4.1	Ukuthathela ingqalelo nokugqiba kuyo yonke imiba enxulumene kufuduko lwabasebenzi ukusuka kwisakhiwo esidala ukuya kwisakhiwo esitsha. 

11.4.2	Ukumema namphi umntu ukuza kwiintlanganiso zePhaneli okanye ngenye indlela ukuncedisa iPhaneli ekwenzeni iimfanelo zayo, apho iindleko, ukuba zikhona, ziyakuthwala yi-DHA.

11.4.3	Ukuxela zonke izigqibo zokufuduka ezithathwe yiPhaneli okanye yi-DG okanye umthunywa ogunyaziswe ngokufanelekileyo kubasebenzi  abachaphazelekileyo. 

11.4.4	Ukuphanda, nokunika ingxelo kwi-DG okanye kumthunywa ogunyaziswe ngokufanelekileyo kuwo namphi umba ophathelene nenkqubo yofuduko.

11.4.5	Ukongamela nokuqinisekisa isicelo esilungileyo nesingaguqukiyo senkqubo yofuduko njengoko kucingwe sesi Sivumelwano. 

11.4.6	Ukuqinisekisa ukuba inkqubo yokufuduka iyagqityezelwa ize iqinisekiswe isiphelo. 




	11.5	IiNtlanganiso neeNkqubo zePhaneli

11.5.1	IPhaneli iyakuhlangana njengoko naxa igqibile ukwenjenjalo, nangamanye amaxesha anjalo ukuba uSihlalo ubona kuyimfuneko. 

11.5.2	Iimfuno zekoram ukulungiselela iPhaneli zingama-50% kunye nelinye lamalungu ePhaneli. 

	11.6	Isaziso seentlanganiso zePhaneli

13.	UKUFUMANA AMALUNGU AMATSHA

15.	ULAWULO LOMSEBENZI
